What Visa should we choose?

#4 is actually impossible, not illegal. It's not a thing.

# 4 is actually illegal, He enters the US. with the intentions of getting married under a tourist visa, that is illegal, yes it does happen but I have seen/know and heard of others getting caught doing this. When caught they are deported, and possibley banned. Chances of getting caught are very small, but why risk it.

You said you will marry in the US in May 2014 that is alot of time possibly enough time to procce a K-1 or better for his work status would get married now and then spousal visa.

It is not illegal to go to the USA and get married. What is illegal is to go to the USA with the intent to stay after marriage.

We chose the CR1 because its less expensive and you're granted a green card upon entry. The whole thing, from mailing the petition to the POE, will take us 8 months. I can travel and work ASAP. It would cost a great deal more for a K1 and take a lot longer to get the actual green card. Granted you can get work authorization and advance parole but you have to wait for both of those and then wait again after the AOS is approved for the green card. Both ways means a removal of conditions in 2 years. (Only if you have been married for 2 years or more at POE does the foreign spouse receive a 10 year green card.)

Those are a quick search of the internet. The question is what was the intent at the time they did come to the U.S.
