VJ k-1 community,

We are thrilled and panicked to announce that we have just received the e-mail notification saying that our I129-F petition has been APPROVED! HOW DID THIS HAPPEN?? We received the NOA1 exactly four months ago (December 10th). We were expecting it to take at least 8 months or more considering all of the information you guys have been posting and with the USCIS national average processing time creeping upwards. I am deeply sorry for all of you who are still waiting the NOA2 and filed before us. We don't know how this happened. It is completely unfair. However, we are very nervous about the interview and need your help. First of all, our case status went from "initial review" to "post decision activity." What happened to the "decision" stage? Is this normal? Will the next packet of information be sent to my house in the US or will it be sent here to Buenos Aires? Also, I have read in some posts that the beneficiary was asked during the interview what their fiancé (me) does (I assume this refers to job/where they live). I have been living in Argentina for the past 10 months and have way over-stayed my visa. Will this raise red flags in the embassy's eyes? I only did it so I could be with my fiancé but now I'm worried this will affect their decision to give us the visa! Any ideas?? Assuming we didn't get approved without having to do the interview, how can we start preparing? I found the information on VJ about the interview to be unclear.

it's normal. we got approved within 4 months as well but we never received the hardcopy of our petition approval. it is not unfair at all. you are not the only one. just be grateful that your papers are being processed as they're supposed to. now, just wait for your hardcopy of petition approval since you mentioned you only got an email notification. in the mean time, get your other necessary paperwork ready for interview such as affidavit of support, the forms you needed to fill out, etc etc.. things go fast once you already got the letter for your medical and interview. goodluck!

Congrats... That's wonderful news. You have nothing to be panicked about or feel like you are cutting the line... You likely frontloaded your petition extensively and received no RFEs. If you look through the timelines of those approved quickly, like yourself, none of them received RFEs and those from July, August that are just now getting NOA2s, almost All of them had a RFE along the way... Therefore, it appears that they are putting through cases that have no issues regardless of dates and it's taking longer for those which likely need more review. Be happy, you have received your NOA2 with lightening speed. I frontloaded ours as well so, I hope to have no RFE and be put through quickly although, ours is at VSC. Ummmm, no.

Unless you are saying that the majority of July 19-mid november filers just all happen to have RFE's

Um Yeah... look through the timelines because I looked through about 30-40 of them... I Never said that everyone that filed in July- August has issues, I'm talking about those who have received NOA2s in April/March seem to have RFEs. Whereas, those recent NOA2s that are from Oct/Nov/Dec.. don't seem to have RFEs. It is what it is... Look for yourself and draw your own conclusion.

And now I'm derailing the thread, but I originally fell into the same trap as you, and felt that because my relationship with my fiance was long-term and well-documented (more than five years), we'd lived together for significant chunks of our lives, and, quite frankly, he's from Canada which has got to be one of the lowest fraud countries out there (as opposed to say... Nigeria. Just saying.) that our petition would be adjudicated more quickly.

I was wrong. USCIS moves at its own pace. I find it unlikely that the reason recent July and August filers have RFEs is because we all apparently are incapable of filling out our petitions correctly. A more likely scenario is that USCIS stopped adjudicating fresh petitions, and instead approving returned RFEs and, apparently as of Monday, lucky November and December filers.

Phew, I think I need to take a break from visajourney for a while. My blood pressure is rising.

ROC filed December 3, 2015, NOA1 12/4/15, Biometrics 12/31/15, ROC Approval on June 16, 2016, 10-Year Green Card received June 22, 2016.

N400 filed September 14, 2023, same day acceptance and Biometric Reuse notice, Interview on 2/13/24: Passed and same day oath. ALL DONE WITH USCIS.
