Hi!

So I thought this day would never come, but this morning I finally received an email notifying me that my GC was being produced (I filed in September 2011). I have no clue if I should be receiving a 2 or 10 year GC and while I will obviously find out very soon what I got, I just want to be sure that no mistake is made which could result in issues down the line (for example if I get a 10 year one when I shouldn't).

I know that to receive a 10 year GC, you have to have been married for 2 years. But is that 2 years at the time of filing? 2 years at the time of interview? or 2 years at the time of the decision?

My timeline looks like this:

August 2010: Moved to US on F1 visa

January 2011: Got married

September 2011: Filed I-130 and I-145 (so married for about 8 months at time of filing)

December 2011: Interview (so married about 11 months at time of interview)

No decision was made at the time of interview and then the long wait began...

January 2013: Had to get fingerprinted again because apparently fingerprints expire and got a request to send proof of joint ownership for 2012.

April 2013: And finally, today I received the email that my card was in production (so married for about 2 years and 3 months at time of decision)

Which event counts? Is there anywhere on the USCIS website that explains this?

Typically it is that if you have been married 2 years at the time of your interview you get the 10 year, but you have a REALLY long delay in approval that may complicate things.

I would say you will *probably* get the 2 year card, but I can't say for certain with there being a year between your interview and approval. That's an odd one!

Anyone seen a case like this before?

(Day 69)06/19/2012 Interview notice!!! 07/24/2012!!

(Day 75)06/25/2012 EAD arrives.

(Day 104)07/24/2012 Interview in Atlanta....Approved!!!

I have no idea why I had such a long wait, it was definitely very frustrating... I thought our case was pretty easy, there was nothing weird? The interview went really well and I expected a decision right away but I forgot a document (I wasn't aware that I needed this but he wanted to see transcripts from my school since I was a student). I sent the documents a few days later and after that it was complete silence. After 6 months I called and asked for an update and was sent a letter that no decision was made yet and to wait another 6 months.

Anyways, I'm just happy to get a GC at this point so it doesn't really matter if it's 2 or 10 years, I just want to make sure everything is right and avoid any issues in the future....

The decision was made in April 2013, and you were married in Jan 2011, so you will be getting a 10-year card. You have been married over 2 years at the time you became a PR.

8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
