Hello!

I am gathering all the info and docs we have sent to USCIS and NVC and my husband's taxes are ready, he presented the taxes with an accountant, and we found out that the marital status says SINGLE. The accountant said that my husband can't present them as he is MARRIED because I am not there and I have no SSN, but later when I get to the states we can fix that.

BUT what's done is done, I will have to take that taxes with me to the interview, and I am so upset about that mistake,

Is there ANYTHING we can do before the interview? My interview is in about a month, I am so nervous about this!!!

Your accountant is WRONG if you were married on December 31 of 2012. I recommend you call your accountant and tell him to review the rules for filing status, correct your return, and make a new copy available to you tomorrow.

I wouldn't worry about it affecting your interview. Your accountant had to put his name on the form so it is his fault. You are not the only person they see with accountants doing that wrong. Just tell them you're upset because you know the accountant was a dingbat, and you are in the process of getting it corrected. The numbers are still OK.

I'm a dual US/Hungarian citizen (both by birth; Hungarian citizenship verification TBA), and my husband is a dual British/Irish citizen (by treaty) from Northern Ireland. We are atheists.

He files as MARRIED, filing seperately.

You have no US income, and are not yet a permenent resident, so you do not file US taxes. This is what my husband did this year. I filed my Canadian taxes as married, spouse as a non-resident of Canada.

Next year you can file jointly.

Don't panic, it is an easy fix I think. You don't have to have a SSN for your husband to file his taxes.

when it comes to the affidavit of support, it is all about the numbers and if he can afford you here.

when i submitted tax returns back then, they had my ex's name on them but they didnt care. even now after being married for almost 3 yrs i had to file as single because my husband not here with a ssn to file married filing jointly.

for your husband now to even get what they call "taxpayer id number" for federal filing tax purposes only, will take 6 to 10 weeks to get it. i just did it this yr until he gets here.

but you cant file married filing jointly unless the other spouse has a ssn or individual taxpayer id number. you cant even file married filing seperately.

I am pretty sure he can file as MARRIED, filing SEPARATELY without her having a SSN.

You have these options to file your return:

- Married filing separately – the easy option not much work and when they ask for wife’s SSN# you just write Non-resident alien “NRA” and you don’t need to do a W-7. You can get your refund faster and e-file.

- Married filing jointly – This is a good option if you owe money, but you will need a tax number (ITIN) for your wife. It is form W-7. I think though that because you WILL be eligable for a SSN very soon this might not be a good option for you. But check it out at: http://www.irs.gov/pub/irs-pdf/iw7.pdf

And yes, as far as the Affidavit of Support goes, Immigration just wants to be sure that he can support you, and that he makes enough money. So the numbers that they are looking at don't change. His income is his income whether he filed as married or not. Don't fret to much, this is all fixable.

THANK YOU ALL for your responses!

I am nervous about the interview (I guess it's normal, also it will take place in a different city....all that it makes me feel stressed) and I was panicking a few minutes ago when I posted the thread.

I am gonna tell my husband to contact his accountant and ask him to correct the taxes, probably that will take long time, since I think he took all his paychecks and forms to the accountant on early March and he just got the taxes this week, But I don't know maybe the accountant can make a letter stating that it's going to get fixed. and I can present the letter at the interview in case they ask about it.

And YES! Like Nina D said, my husband told the accountant that he wanted to file as MARRIED FILING SEPARATELY and the accountant said it was NOT possible because I was not a LPR.

Oh my God!, definitely my husband needs to find another accountant for upcoming years!!

Yes NinaD, we want to think that numbers are the most important part in the affidavit of support, they wanna verify that I won't become a public charge.

But still, hehe I was panicking about the marital status :blush:...I just wanna make sure everything is correct for the interview, our 1st anniversary is coming up and we are not gonna be together, we will have to wait...and this process will be a little more than 11 months by the time of the interview!,

All I want is to have a normal marriage like anybody else, I wanna live together with my husband, not being miles away from him. And that's why I feel so frustrated when I see think that a mistake can complicate things.

I would be surprised if they ask you about the married status on the tax form, but if they do you can explain it and that it is being fixed. They didn't ask me anything about my husbands tax transcript at all.

Good luck and try not to stress to much. I know how hard it is not to though! LOL

Thank you! Yes it's really hard to don't stress too much hehe but I really hope everything will work out nicely. And I talked to my husband and he is going to make an appointment with the accountant to talk about it, also he asked for a letter from work where states that they have updated his marital status from single to married. He will mail all these docs to me and I will bring them to the interview!
