Just Called USCIS October Filer

Hi all,

Just wanted to share. This was my first experience calling USCIS, I'm October 24th NOA1 at VSC so my 5 months have past now. She asked me how long has it been, I said more then 5mo now, more then the time line on your website, so she said "ok I will file a service request for you", then she asked what is the date on the NOA1, I said 10/24, and she goes "oh well its within our processing time, we are currently processing 10/1, wait about 23 day." There is nothing worst then waiting for something and not knowing, I can't even begin to describe it. At this point I don't know if I'm just venting or what.

[August 23rd 2013] I call DoS and they tell me my interview date, (2 weeks since I sent ds-2001)

[August 27th 2013 CEAC update - London dispatches packet 4]

[August 29th 2013] Packet 4 received
[september 24th 2013] Interview -
Refused due to passport and birth certificate condition

[september 26th 2013] Emergency appt at HM Passport Office London - New Passport and Birth Certificate in hand
[september 30th 2013] DX collects passport and birth certificate

[October 3rd] - Docs delivered to Embassy

[October 10th] - London Approves and Issues our Visa!!

[October 16th 2013] 4.00pm - Visa in my hand, 11pm POE -Newark

Patience is a virtue and we need to have plenty of it.

we were 8 month til we got our NOA2 back in 2011.

i know it is hard, not knowing, wishing someone would tell you something in order to have a piece of mind.

As hard as it is to do nothing regarding the UCSIS, you might as well. Calling the UCSIS is a waste of time and just frustrates you even more.

Most people getting NOA2's lately have been contacting their congressman etc.

I KNOW IT'S A LONG WAIT AND ALOT OF PATIENCE . WE ARE JULY 2012 FILERS AND WE WERE APPROVED APRIL 4 AFTER 1 RFE ... IT WILL GO BY FAST JUST HANG IN THERE

Wish I was in your boat, for I too am an Oct filer but unfortunately my petition is at CSC. Good luck!

Wow October 2012 filers getting frustrated and so many who had filed before them are still waiting xD Good luck folks. I hope we'll all be with our loved ones soon!

I hope the information they gave you is true, I am also a 10/24 filer, however that completely cotradicts all info that we on this site have been able to formulate. Most here have it figured closer to 90 days for October filers assuming CSC starts moving again.

I am a newbe on this site but was looking to ask a question and came across this forum. I am also an Oct guy. the Fourth to be exact. 10/04/2012. It is at the CA processing center. Does this mean I am getting close?

Second question. Has anyone reviewed the form I-134, affidavet of support form. It does scare the ####### out of me a little bit. I am 55, retired early and not my first rodeo, as I am sure is the same as others. This form pretty much has you signing off on the "sounds" like fact you are going to be responsible for financials of fiance and daughter. That is fine, but what if you get divorced. Any input on this would be grealy appreciated.

No one plans on getting divorced but as noted, not my first rodeo and have worked hard my entire life to only lose half of it as I did in first marriage in States due to divorce. We are planning on living in SD. I have a solid retirement and investments that I want to protect in case of divorce., in second marriage to an American, I had a solid prenup that covered my assets that I already had before marriage and pretty clean divorce in keeping them when we divorced.

I love my Thai fiance, and her daughter very much. I am just trying to be realistic in knowing that while we could be good for the next 50 years, Shi...... happens. If it does, I do not want it to wipe me out. Will a solid prenup keep me out of trouble. I have zero problem with us sharing all assets gained from day we are finally married.

Just want to ensure that my grown kids and their familys, my grandkids are covered in the future by current will and solid prenup.

Any, all help, guideance, assurance or reality checks would be greatly appreciated.

You really should make your own new thread to discuss this, as it isn't relevant to this particular discussion, however, here's my basic understanding:

1. The I-134 and the followup 864 (when you adjust status) are both used to prevent your fiance/spouse from getting GOVERNMENT assistance, i.e. welfare and food stamps. That is what you're guaranteeing and pledging, that if your spouse reaches that level of need, that you will provide a minimum level of support. And in fact, it actually would take the government suing you to enforce the I-134 provisions, so in most cases it never comes to that. It does not end upon divorce -- even if you divorce, you are still required to ensure that she does not receive welfare. It DOES end after she has worked 40 quarters and qualified under her own terms, or if either of you die, or if she gives up her residency and returns to her native country. I have heard rumors of the I-134/864 being cited in divorce proceedings but in followup, those cases have almost never come to fruition and it cannot/should not be used against you when dividing assets/alimony. If anyone has a solid factual citation of it successfully being used to determine alimony, I want to see it, because I have not yet run across it.

2. There is no harm in having a prenup. There are many people here on the forums who dislike them, so you're bound to hear opposing views. I personally live in a community property state, and we are in the process of getting a prenup ready -- my fiance is completely 100% on board with it, we both think very realistically and want to protect not just our own, but each other's well-being. And we're doing it in love and respect and it is full of romance and I dare anyone to say otherwise! Your details of course, are up to your lawyer and you to discuss.

The prenup issue is contentious so I'm sure you'll get an earful. But a prenup will have no impact on the visa stage and is truly a protective measure for those of us who live in the real world and have a significant imbalance in assets.

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

This process requires a lot of patience. I am not sure where the 5 months came from. from my understanding and experience it is 6 - 7 months. Either way you have made it most of the way through the waiting.
