Hello everyone,

I am a US born citizen wanting to petition for my wife in Honduras. Previously in May 2012 I petitioned for her as a fiance because I wanted to get married in New York but that was denied since I didn't send any evidence and so I gave up on getting married in New York. We got married on February 22, 2013 here in Honduras and I've been living here for the past 4 months (since December 8th). Before December I've been flying back and forth since I'm only allowed 90 days in Honduras mostly maxing out my visa here. Currently I've been here on a 90 day visa and asked for 30 extra days at Honduran immigration which I received. As you can see that time is up (today is April 9th). I'm also in the final process of becoming a Honduran citizen through my mother's nationality. My life has basically been here in Honduras for about 1 year and a half just that I've had to be out of Honduras for at least a week after my visa has been up. This time I've stayed since I'll be receiving my Honduran nationality soon and I was advised to do so freely by Honduran immigration.

My questions are:

Can I do DCF in 2 months even if my status was as a tourist here for these past 4 months?

(I understand the minimum time for residency is 6 months)

or

Will I have to wait for the citizenship and then also wait the 6 months to past before I can file?

And can I even apply as a dual citizen who acquired foreign citizenship through a parent?

Should I abandon applying for Honduran citizenship and just apply for residency instead?

Also is it hurtful that we were denied for the I-129F?

Note that I have no intention of residing in the USA without my wife so therefore I'm planning on applying at the embassy.

I apologize for the long story but I wanted to be as detailed as I could. Thanks in advance!

I am petitioning for my Honduran wife and have many similarities to your story. I have done extensive reading on this subject and have answers to some of your questions. The previous application will not have an effect on your current petition.

Spending time in Honduras myself, I would predict that YOUR income would be less than required to qualify as the sole supporter for your wife - but I do not want to assume anything-

Are you preparing your documents that will be needed in the steps to come? The Affidavit of support (I864) also gathering the documents necessary as evidence Birth certificates, marriage certificates, etc etc- You will also need all the information on your wife for her application for visa ( DS230)

would like to help- I am also an american married to Honduran- I was living in Honduras for years- we had a daughter while I was there- but needed to return for financial reasons----

while I am here- I am processing petitions for my wife and stepdaughter-- if you have questions let meknow- your post is old and I am not sure of your current situation.
