Hello Everyone,

I have few questions, please help me out:

1.) I am applying I-130 for my wife, will use my salary as only income, and it's only her no one else, do I apply for 864EZ?

2.) I have paid AOS fee and submitted my Choice of Agent letter, can I already submit my 864 Affidavit of Support? If yes, can it be through e-mail or it has to go through regular mail.

3.) I am trying to speed up the process. Any tips/tricks will be greatly appreciated.

I have read all threads / general sections, etc. in this website.

If you are applying for your wife that is the I-130 your correct.

You will also include the forms G-325 for both of you.

The form G-1145 is optional ( E-Notification)

Once your I-130 is accepted and approved it will get sent to NVC.

Then they will send you a letter or email and tell you to register the choice of address and agent online at https://ceac.state.gov/CTRAC/Invoice/signon.aspx

Then you can pay online the fees there. And then they will send you the receipt of fee.

Then you can apply for the visa and pay for that.

If your doing the I601A waiver you will need to let NVC know in An email Fter you pay the visa fee and before you apply for the visa.

Then that's when you then do the I864. They usually will guide you by letters.

Well for the next stage after you are approved at USCIS is NVC. Go here to the NVC filers thread and read Post #1and #2.

Now you do know that all you mention doesn't go to USCIS. Are you just filing? You need to go read the guides. The I-864 has nothing to do with filing with the I-130 petition.

Answers:

  1. You are not applying an I-130, you filed an I-130 petition form. Also, you don't apply for an I-864EZ, the I-864EZ is a form you file provided you are able to answer yes to all 3 questions at the top of that form. If you can't answer yest to those 3 questions, then you must use the I-864.
  2. What country is the beneficiary from? The ability to email documentation to the NVC is only available for cases in certain countries.

You guys, my case was already approved by USCIS and forwarded to NVC. I also have a case number and have paid my AOS fee. Today I also filled out the choice of agent form and emailed it to them.

Now to my questions:

1. I am applying for my wife, using only salary as income, can i use 864EZ.

2. It says online that i can email my form instead of mail even though my embassy doesnt isnt in the list of supported embassies.

Please help. Thanks

Answers:

  1. I'll restate what I said earlier, look at the top of the EZ form. There are 3 questions, if you can answer "yes" to ALL 3 of those questions, then the EZ form can be used.
  2. As you state, the Embassy/Consulate your wife will interview at does not appear on this list of countries where Electronic Processing or use of online forms is available. Therefore, you MUST mail your packages to the NVC, end of story.
