Will we get RFE'd?

I'm a little worried about something. It came up in conversation tonight with my fiance that his parents never legally adopted him (biologically she is his auntie and his biological mother gave him away from birth). In our I129F package, we listed them both as his parents and mentioned this in our letters of intent/supporting statements and such. He said that in every legal document that has ever been filed (including taxes and passport) since birth, has had his parents listed as his parents, but on the birth certificate it says his biological mother(Sandra) which has also been sent to USCIS. His mom (Mary) is our co-sponsor and she of course has her birth certificate as evidence of being a USC.

Do you think we will get RFE'd for an adoption certificate (which we don't have)?

Which of you are the USC? I will assume him as you mention his taxes.

How old is he? If over 21, it really does not matter who his parents are/were as long as the form matches the birth cert. He should just be able to list whoever is listed on BC as mother and father. His auntie can be the co-sponsor but that is only for financial means. Passport and taxes don't care who your parents are unless you are under 18.

U don't have to be worried about REF anyway , they might ask for correction on the I129 F to match ur fiance's birth certificate (his biological mum's name).N.P : that is only personal opinion, I Hope u won't get REF even though i got one for missing letter on intent

If I am reading correctly, then I would conclude that "he" is the US Citizen petitioner. If that is the case, the the answer to the question I quoted would be no.

He's 28 and he is the USC. He never knew who his biological father was and his biological mother handed him over as soon as he was born. Every document he's ever filled in (including ones to the Dept. of Homeland Security for passport etc) list Mary (his aunt) as his mom as in their family, for all intents and purposes, they're the only parents he's ever had. He doesn't think we'll get RFE'd because it has nothing to do with our ability to marry or anything like that, but it's just bugging me.

Oh and I don't know if it matters, but his biological mother passed away ages ago. His mom now is the only one he's ever known and has been his legal guardian since he was a newborn.

He is correct, there will be no RFE for this.
