Re-entry to the US

In 2002 I entered the US for a holiday on the VWP, I had a 6 week return journey ticket (I had no intention of staying), whilst there I was asked by the person I was staying with to marry her (I know it sounds crazy as we only talked online for 2 years prior, she was a full US Citizen and part Cherokee). We got married and lived Happily for 5 years, we made many trips to the Indy INS and had a lawyer also but there was some confusion and we were told different things by a few different people and the ajustmeant process was held up a lot. In 2007 she decided she wanted a divorce before my status was ajusted so I left and came home via plane. I was not spoken to by anyone not searched nor was my passport stamped with anything, all I got was a smile.

I met a lot of nice friends there and would like to see them again so my question is: would I be able to return on a visa or would I be subject to the 10 year ban?

Also just to confirm something else, not sure if it will help but I can prove I have more than sufficient ties to the UK and will be unable to overstay again.

I believe your overstay does not allow you to travel on the VWP, could you apply for a tourist visa?

Of course it is possible, but you will not know the outcome unless you apply
