Long story, lots of issues, please help

Hi I would like to get some advises for our situation. We are about to send our AOS package and I' m so stressed about some issues.

I came US on 2009 december. Entered country legally with 5 year F1 visa and 1 year valid passport. I studied 16 months and at the end of education I moved to another city. My I20 expired couple months after I moved. few months later I met my wife online and we dated 10 months than got married 2012 march. my passport expired after a year and because I wasn't attending a school I was out of status because absence of Sevis/I20. Anyways, just before we got married my wife had to quit her job and worked few part-time, agency jobs. Because of our financial status we couldn't apply for AOS until now. Now we fixed our financials and started preparation of AOS package. But the more I got into it, the more i got stressed and worried. here are the things I really worry about. any advice is appreciated;

I-130 package asks for proof of current relationship with certain documents. We have been living together for two years (from 7 months before we got married until now) but the only common residence lease is the one we first moved in which we lived only three months. then our house broken into and we had to move out somewhere else. And the new apartment complex didn't add my name because I have no SSN. So I added the first rental lease, and an utility bill on my name on second address with the lease on her name. We went to bank to open a shared account or add my name in her account and same issue, they didn't accept because of SSN, and absence of valid photo ID. They checked my passport not valid, checked my visa, seems like it's valid on visa ( expiration is 2014 ) but they said they need the I20 with it to be accepted as ID so failure. Insurance, car etc all returned failure because of not having an SSN number or valid photo ID. Also none of them accepted my ID card from my country as valid identification. We filled all the forms, got the IRS documents, because her income for 2012 was not enough my mother-in-law signed an I-864 form. all forms are ok, but just before we send them I'm kinda scared that this poof of ongoing relationship documents will cause a bigger problem.

So in conclusion I have

- no valid passport

- no valid F1 visa ( overstay )

- no other valid photo ID

- and nothing to prove that this is an ongoing marriage on paper

what should I do? what would happen the worst case?

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Moved from adjustment of status from family based visas to adjustment of status from work student tourist, as OP did not enter on a family based visa but an F-1 student visa.

But I'm applying for AOS based my marriage? My F1 is not valid and AOS application is not based on work or student or tourist visa??

You are adjusting from an F-1 and not a family based visa such as the K-1. The process is different.

Can't you go to your consulate and apply for a new passport?

At this second I can not because of my age the first thing they will ask me to go back and attend army. after 29 army service is a must for Turkish citizens and when I called them just before my passport expired, they said I need to bring my papers to prove that I'm done with the service than they can extend it otherwise I can not and have to return back. Because I was attending school that time I didn't return also couldn't extend it

I don't know if you can apply without a valid form of ID but I'm sure somebody else knows.

When I applied my passport was still valid, but it expired short after and I didn't have a problem.

Hopefully somebody can help you.

Also do you ever plan on leaving the us before you become a US citizen, because you would need a Turkish passport

No I don't plan to (can't) leave before I finished everything. there is only one way, after immigration process I can apply consulate to pay for my service because I am a resident here. BUt for that I have to wait until AOS solved.

You are adjusting based on your entry as an F-1 you did not enter with a family based visa. No one in the other forums can help you with your question because they all entered on a family based visa and have no issues like you have. That is why we have two forums for adjustment one for people who enter on other visas such as F-1 like your situation and one for the others who enter on family visas.

USCIS understands that some people cannot co-mingle things because they do not have a SSN. There is nothing to worry about, in that regard. Send what you can, and worst case, when they interview they will separate you and ask about your lives. If you know eachother and really live together as a married couple, then there will be no problem.

There is no requirement to have joint anything. It just helps paint a picture of yourself so they can determine if you are in a real marriage or just did it to evade immigration laws. Since you are adjusting in-country, they have access to you, so to speak, so they can interview and do house drop ins and things to their hearts content.

That probably won't happen anyway, but you should not be worried about evidence of co-mingling. You have a good reason for not having it.

You will need all of your expired documents to do AOS, though. I hope you still have them.

Yes I have every single document,file, passport, driver's licence etc even if expired. Should I add some pictures of our wedding ceremony, anniversary etc?

I dont think you should worry about the passport or the joint docs, kinda in a similar position, my passport expired a couple days before AOS package was received. So far everything is going asschedule, even went to bio appointment with expired passport. We literally have no joint anything because of the ss# issue so we are hoping to get ead before appointment.

As Harpa said worst case there might be more scrutiny but im not worried about it, because we are a real family. You will be fine Good Luck!
