The USC wants to move abroad- what to do

Hi there,

I am the beneficiary and my husband is in the US for the moment. He would like to come to Romania, so we can live together, as we do not want to be apart any more. We sent the I-130 and we got NOA1 on the 21st of March.

I want to know how we can go through the process once we get NOA2, if we both live abroad.

I tried to find the procedure for my case on here, but I only found discussions on different cases, nothing general.

Can someone help me with a link?

YOU, the USC, only really needs to worry about the income requirement. If you are abroad and not working, do you have enough to meet the requirements? Other than that, the beneficiary will do most of the work after the NOA2. Someone will come with more specific answers based on experience I am sure

Of course you can! There are tons of couples here on VJ who live abroad together. There are a few things to take into account, though.

1. The financial requirement, as canadian_wife mentioned. Of course, of this is a problem, you can always use a joint sponsor. If you don't think you'll be able to find a joint sponsor, I'd reconsider this moving abroad idea. Also, regardless of whether you have a joint sponsor or not, your husband is going to need some work documentation for the AOS (IRS receipts, employment letters, pay stubs), so make sure he'll be able to get this before he packs everything up and moves.

2. Your USCIS listed address. If you've already put your husband's US address, they're not going to let you change it to the foreign one. For some reason they've been insisting lately that they don't send mail abroad (this is a lie) and so when you call to update the address to somewhere outside of the USA, they're going to tell you it's impossible. So, I would suggest making sure somebody can check your mail for you at whatever address you've used as the listed address on your I-130.

3. Also, your husband is going to have to prove domicile during the NVC stages - in other words, he's going to have to prove that he intends on moving back to the USA once your visa is approved. This can be done through leases, bank accounts, insurance, etc, but just be prepared to have this extra paperwork to do.

Some couples have been deciding to move abroad halfway through the process with the idea that they're going to be put into the "filers from abroad auto-expedite line", but this isn't the case, so hopefully that's not what you guys are expecting!

i am doing it from abroad and haven't had any problems yet. i got my NOA2 at the usa address since it was my dads address but they also emailed me a notification saying it was approved. since i have been transferred to NVC all communication from them has been through email which makes it a lot easier. the only annoying thing was that when i sent in paperwork it took a long time in the mail... right now my case is complete at NVC and am waiting on an interview appt. you will have to prove domicile in he USA when you file the i-864 but i think if you show you were working and paying taxes in the states as recently as this year then they won't question it too much. i didnt; send a whole lot of evidence and it seemed to be fine. just 2012 taxes and a letter from my boss in the states saying i was coming back. the only time i got held up was with the ds-3032 (choice of address and agent) listed my foreign address which did not match up with my i-130 address so they asked me to do it again and i just listed my usa address and email. as i said everything with NVC is through email anyways so the physical address doesnt matter much. here is a link that explains how to send the ds-3032 through email instead of through mail to save time. http://www.visajourney.com/wiki/index.php/Email_DS-3032_form

Here are my questions:

1. My husband is working now in US and he will be working till may. Do you think a letter from the employer saying that he has been working there and he earned X dollars there, would help? We have some pay stubs too He has some money in an account in Romania and he also has an open account in US. He has some internet bills as well from the place he is living now (by the way he doesn't own the house he lives in... is this a disadvantage?). A friend of his owns the place and promised to get him back any time. He has been living there for more than 2 years. We might get some old bills too.

His parents live in a different state. do you think they can be our joint sponsors if they do not live in the same state?

We do not wish to use the auto-expedite, we just cannot stand being apart. I know living together abroad will give us a hard time with proving he can support me.... but we'll see how it goes.

Other questions:

- can we pay online from here the tax for I-864? I know it is needed to use an us account...

- do we still need to send the packages separately once we get NOA2?

- ahhhh, I had so many questions, but I forgot them :(

On my I-130 i mentioned my husband's US address where they requested info about him and my Romanian address where they requested info about me.

On the DS 3032 I will tick :" I do not appoint an agent or an attorney....etc. and mention the Romanian address and my email address. Will this be ok ?Or am I missing something?

Do they require the US address on the DS3032? Do I need to put my husband as an agent?

if you list the petitioner as the agent then it has to match to the same address as on the i-130 (i am the petitioner and messed that up the first time putting my foreign address which didn't match since i had moved) you can put yourself the beneficiary as the agent with your foreign address. i guess the point is it just has to match teh i-130 info.

his paretns can still be joint sponsors, doenst matter what state. for me my mom was my "joint sponsor" (we both filed i-864) and then my step dad filed a i-864A as HER "household member" so they do have to live together and show their relationship. if just one of his parents is the joint sponsor both he and the parent will file a i-864. (both must supply taxes) he will supply his taxes in that package which will help towards proving domicile.

the fees for the i-864 and the ds-230 can both be paid online but i think have to be from an american bank account so he should keep one open with enough money in it.

i have heard some people send the packages together and some apart. i sent my separately since i was billed separately but i don;t think it matters which way. when you get your NOA2 and are contacted through email by the NVC they will send instructions that make it more clear to you. the best thing you can do is start getting documents together that might take longer, police records, birth ceritficates, taxes.... stuff like that so you don;t have to wait for them later.

His parents can be joint sponsors without a problem! It doesn't matter if they live in a different state. The main joint sponsor would fill out an I-864, as well as your husband, and then assuming your in-laws live together, the second joint sponsor would fill in an I-864A. (ex: your FIL does an I-864, your MIL does an I-864A).

Hi Darnell,

I really don't understand the american taxes system and maybe you can help :)

We got married in Romania in December 2012, he went back to USA and came back here in January 2013.

In 2012 he worked in USA and I worked in Romania. I live here for now and pay taxes here.

Why should we file for W7? To get the benefit of reduced withholding ? Is it mandatory?

Why should we file taxes as married filing jointly if I have never been to USA?

When can you file exemption on your taxes? Can I be considered exemption on his taxes, as I never worked in USA and I pay taxes here?
