So here's what happened: At my interview for the Fiancee Visa at the Vancouver Consulate, I gave them the original W2 and original paystubs as part of my then-fiance's Affidavit of Support. They took these and put them in the brown envelope I was to bring for the customs officer at my POE (Las Vegas).

Now, I just realized that these are needed for I-864 and it didn't occur to me to make copies of these documents (kicking myself really hard here). How do I get these back?? Is it possible to get these originals back? Who do I contact?

Or would it be quicker for my husband to request copies of them from his HR office?

Ouch, I would imagine you might have more luck trying your husband's HR office. I don't even know where you would start to get these back from USCIS. First you would have to know where your file is, I guess. Could you maybe get tax transcripts and put in a note saying W2's already submitted at POE? Doesn't it all end up in the same file anyway?

Two things,

  1. Get tax transcripts from the IRS, they are free, and are accepted in place of the W2, and 1040s. http://www.irs.gov/faqs/faq1-6.html
  2. By the time you do AOS the pay stubs would be old, they dont need 6 months worth anyway. Read the instructions included with form I-864EZ, they indicate that the pay stubs and letter from employer are optional and can be included if you think they would help your case. I-864EZ

a stupid question:

while filling out all the forms required for AOS, EAD and AP, do I use my maiden name or my married name?

we're going to try to see if my husband's employer can provide a copy of the W2 first. if not, i'll request a transcript from IRS, and keep this in mind if I really need those original documents returned. thanks!

ajmc,

You use the name that you are going by. What name do you use these days when you are introduced to someone?

Married name, there are spaces for "Other names used" in the I-485, G-325A, I-765, and I-131, that is were you put your maiden name, unless you don't use your married name.

Also if you don't plan on leaving the country save some $$ and hold on the AP

Good luck.
