Sorry to bring this topic back to life but I am in the same situation and have some questions as well...

I am my mother's dependent and only work part time so she will be my husband's joint sponsor for his AOS from K-1

My question is.... Why do I fill out the I-864 if I don't meet the poverty guidelines and am my mother's dependent anyway?

Would it save paperwork to ONLY have my mother fill the I-864 in conjunction with my father filing I-864a because they file their taxes jointly and the transcripts reflect their joint household income (my SS is listed on each of their tax transcripts as dependent).

I have my tax transcripts but my earnings are measly because I am a student.

In my mind it feel like zero-ing in on my mother's income as the sponsor makes the most sense but I am finding conflicting answers around here...

If anyone can help, I'd really appreciate it.

The petitioner is always the primary sponsor, even if they earn zero income. You must fill out the I-864 as the primary sponsor. It does not matter that you do not meet the income requirement. Provide your supporting documents and have your mother fill out her own I-864 and your father an I-864A to go along with your mother's I-864. They will provide their own supporting documents and will act as your joint sponsor.

It sucks, but you gotta do it. During K-1, I lost my job right after I received John's NOA-2 (go figure), and my dad had to step in and co-sponsor. I-864 from my dad, and I-864A from my mom, plus three months of dad's paystubs (six total), and the last three years of tax transcripts (they filed jointly). Tax transcripts are free from the IRS at 1-800-908-9946.
