I think you have every chance of being successful with this. You did not know your now fiancee when you entered the US on 25 Jan, so you did not enter the US with the intention of getting married - this is the main reason that people fail in AOS from the VWP. As you met for the first time at church, there would presumably be witnesses to that first meeting and that it was, in fact, your first meeting?

Having said this, it would be useful to speak with the lawyer tomorrow. It may be worth engaging a lawyer, if you feel that this is the right person for you. Ask if they have experience of AOS from VWP. Although you know that you are genuine, USCIS will be trying to ascertain whether you are.

This is certainly not a planned or expected path for me to take. Leaving behind friends and my family in the UK is a huge decision for me but I really feel like I have met the woman of my dreams and cannot imagine being without her. I have lots of witnesses of the first time we met and also have plenty of friends that would be willing to help us prove we are a real couple. I had no intention to marry or stay in the US - we just fell in love and it went from strength to strength.

I will ask my lawyer tomorrow if they have personal experience of AOS from VWP. Does anyone have any ball-park figures on how much it would cost to use a lawyer (california).

Also my filing location would be LA if that makes any difference...

Thank you for your input, glad to see a few positive responses. The next few months will be nerve-racking but all these challenges will only bring us closer and more appreciative of the time we can spend together. :)

To be honest with you, most people on this site are going through the process whilst being separated for many months - in some cases, years. You are lucky in many ways - to have found love, like all of us have - but to be able to go through this process whilst physically together will make it so much easier for you. I am still waiting for my NOA2 (I am going the K1 visa route) and we filed in July 2012. A lot of us who filed in July 2012 are still waiting. Being physically apart is the most challenging part (although I am in the US at the moment on the VWP).

Good luck to you and your fiancee on your journey and I hope that you AOS okay after your wedding. Let us know how it all goes.

If you hire a lawyer to handle the entire AOS process, it will cost anywhere from 3K to 5K depending on how much the lawyer charges. That should include all USCIS filing fees.
