Hello all,

My husband (Belgian citizen) and I (US citizen) are residing in London and will be looking to submit a DCF application at the US Embassy in London.

I am worried about submitting form I-864 though. The form seems to require 3 years worth of federal tax returns. I was not working before (was studying), and have only just started working from Aug 2012 - present. Thus, I have no tax returns to show. I currently make £45,000 GBP.

My husband currently makes £60,000 GBP a year and has over £200,000 in savings in his Beligan account.

Can we use my current income, his current income, or his savings to push us over the poverty threshold?

You need to use income that will continue when you move to US. Your current income is totally irrelevant from this point of view. Also, if you worked in 2012, you should have a tax return (as you are required to report all your worldwide earned income to US IRS) sent it this year (unless you're about to do that in next 7 days).

Moved from spousal visa to DCF as the OP stated they will file DCF.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

I think if you are a US citizen living in London, you have a two month extension to file taxes, so I have to submit mine by June 15th, not April 15th.

I still do not have three years worth of tax returns however.

Will this be a problem when it comes to submitting my husband's documentation?

I think if you are a US citizen living in London, you have a two month extension to file taxes, so I have to submit mine by June 15th, not April 15th.

I still do not have three years worth of tax returns however.

You will need to explain why you did not file them (if you were not required) and you still will have to meet income requirements for I-864.

Thanks, Kzielu. I will explain that I was not working working in the last three years, up until starting my current position in August 2012.

I currently make more than the 125% above the poverty level - but does that have to be shown for the last 3 years?

Can my husband's income/savings help as well, or will I have to get a sponsor?

Your current income in UK is not going to count (which is what I was trying to say in 1st post). You need to have a US-earned income or a source that will continue once you move back to US. Same issue with husband's income.

You can try to qualify using assets, but I don't really know how to do that if those are foreign based and what are the requirements for those. I would start looking for a co-sponsor...
