Hello all,

I am an American citizen (born in New York) and now living in London. My husband is Belgian, and we have been married snce May of 2012. I received my EEA visa, which allows me to live and work in the UK/EU in October 2013.

We are considering a move back to the US in January 2014, and have just started to look through the process of getting him a spousal visa for the US (yikes, there is alot to read!)

Can we apply for his visa through the UK Embassy? If so, how long will the whole process take, from start to finish?

Hello all,

We're just about to start the exact same process. You have to have been living in the UK for 6 months before they'll let you file direct.

The information on their website is really good - there's an example of a completed form which is nice. http://london.usembassy.gov/dhs/uscis/i130filing.html

The process looks like it'll take about 5 months or there abouts as an average. It's taking them about a month or less right now to do the initial form approval, then the rest of the time is very variable for them sending back forms, you returning them, having medical and then finally them scheduling interviews. I've been following the cases of folks who've been hitting London after NVC for both CR-1 and K1 and it seems to be taking folks about 2 months from Packet 3 to interview at the moment. If you want to move in January, I'd file as soon as you hit the 6 month residency requirement in the UK.

I'm a little confused about your post about whether you already live here or not. If you're not moving before October to the UK, then you won't meet the residency requirements. Maybe instead of " in October 2013" you meant "until October 2013"?

1st May 2016 - N-400 window opened
20th August 2016 - N-400 filed

30th May 2017 - Interview (approved)
7th June 2017 - Oath

Thank you for your reply! I'm sorry, I received my EEA residency visa in October 2012. I have been living in the UK for the last couple of years already, and we currently still live in the UK, if that clears things up?

Oh,blah. Yeah, that makes tons more sense :) Then, yeah, so long as you've been living in the UK you're good to go. I emailed this address to check we're good to go, and got a reply in the same day. It was very useful: USCIS.London@uscis.dhs.gov
