I am on the same boat. No income in 2012 bu i got w 2 from my previous employee which had wages and tips for $20 .56thats why i didnt file tax returns coz there us no income i dont know what to do. I am thinking of sending the copu of my w2 iyh an explanation that i had no income coz i was international graduaye student that time and was not allowed to work.

But strange situation is i have w2 for $20.56 and taxwitheld is $000 which i beleive they made the pendig payments for 2011 when i used to work on campus for few hrs in 2011.

IS there anyone with this situation where ur w2 has some negligible income .Should i filetax return now or not. even if i file it dont make anysense coz i dont have single penny of tax witheld. What to doo please suggest.

Just keep in mind that you don't have to file income tax return if your income is <$3,000 for filing married separately. Or if your single, you don't have to file if your income is <$9000. Just write a letter of explanation that per IRS, that "if you earned below the minimum income for your filing status, you may not be required to file a Federal Tax Return"

Call them - get the exact wording from them - I got a stupid checklist just cause my wording wasn't right - lucky for me I had also went ahead and submitted an empty tax return b/c i had no income last year - so I'm just going to send the IRS return transcript to them - when I had sent my AOS the IRS didn't even have my return at that time b/c I submitted it later.

So call them tell them your friend had this checklist sent and you don't want to be in the same 4 week delayed situation 4 wks later so tell me exactly what to write on it. After that is up to you and your luck I guess :(

Can someone tell me if there is a criteria to send DS 3032 through email or anyone can send DS 3032 through email ?

ALso how to send DS 3032 through email ?

Well, the only reference I've found, is http://www.uscis.gov/files/form/i-864instr.pdf page 2 part How to file the form, item 2. They don't specify explanation letter explicitly, which makes it hard to guess, really.

I guess, it's better to sign every letter you address them.

Thanks for the great advice. I earned $202 last year, but I was told I am not required to file taxes. I would write them a letter of 2 lines stating what you mentioned above and sign it.

Then my joint sponsor, my mom, has to file in I-1864 with me as well.

Now my question is my mom has met and is above the requirement of poverty line for the minium specified for the year 2009 , 2010, 2011.

But for 2012, because she was sick she had not worked for 6 months and only filed for taxes for the 6 months she worked her income was 12,000k gross 9000. She clearly does not meet the guideline for the poverty line for year 2012. But now she is self-employed and starting working again since march 2013 and pays tax quartely with a income of $2500 monthly income.

Sponsor size should be looking at line 2 ? or line 3 or minimum household? I was told by a rep it is 2 but just confirming. As it is me , my mother, and my spouse.

So will that year 2012 will be an issue?

What is the best way to tackle this situation.

My brother has worked in 2012 as well as has made 21k and gross 18k and now has lost the job. Should I have both of them be the joint sponsor as well all live at the same household to meet the poverty guideline ?

I am confused...please help...

What happened is the following. I did not make any income in 2012, therefore I sent them a letter explaining that I did not make any income therefore I did not file a Federal income tax return for 2012. This is what the instructions say to do. When I called them they were like yea you are right but we can't do anything about it now, just resend us that letter again and it will take another 20 working days to process. This is what pisses me off.

Now it happens that after I had submitted my AOS, I also submitted my tax return of $0.00 just for this day anticipating that they will make a big deal out of nothing. So I am going to send it to them tomorrow. I just am pissed off that they are going to take another 20 working days just to see my Tax Return transcript of 2012 which says that I earned $0.00

I hope it works out for you. I know you must be wanting to complete everything before September 30th as well....But as per that USICS a case intitated will not be affected if retrogressed...won't they give you an interview date if your file is in process..

"Therefore, it is likely that a cut-off will be imposed for October. This cut-off is unlikely to have any negative impact on those who have already initiated action on their case prior to the announcement of the October cut-off dates"

Noa2 receipt date Aug 6, just called NVC they said they haven't received my file . MAn it ls already 10 days from.NoA2 whats going on with them.Did they stop processing new files now since f2a is goint to retrogess in october??

I got my case number 13 business days after NOA2. Monitor other people's timelines so you'll have an idea. Start collecting and preparing your AOS and IV packages now.
