Finally after 14 dats NVC got my case on their system, still no case number...

Your husband has to meet all 3 conditions in order to be able to use this form i864 EZ.

1. I am the petitioner of the family member sponsored on this form - correct Your Husband is the petitioner and you and your children are the beneficiaries

2. I am using only my own earned or retirement income, which is documented using IRS form W2 - correct, your husband is using his own income

3. Sponsored immigrant is the only person immigrating in this petition - incorrect, because he is not just sponsoring you, but also your 2 children, therefore he will have to file the regular form i864

I need help again please.

I am confused with the instructions on which form to use in the AOS.

All three of the following are true:

• You filed a Form I-130 petition, for your relative
• There is only one applicant on the Form I-130 petition, and
• All your qualifying income comes from a salary or pension and shows on one or more W-2 Forms that you receive

My husband filed only 2 W-2 forms for 2011 and 2012.

And included in the form I-130 are me (principal applicant) and I have 2 children. So which AOS form should we use?

Is it I-864EZ or i_864?

What kind of police clearance? You mean you have to send them nbi clearance and police clearance as well? Sorry just confuse.

That's what i asked to NVC Agent via phone. They told me that it depends on US Embassy of Manila. and they are scheduling case completed applicants for September 2013 already.

July 2013 Visa Bulletin of 8 Oct 2011. That means people whose cases were cleared and interviewed who had a priority date of Oct 2011 were getting their visas.

Your PD is Oct 2011 as well. Think about it, even if they retrogress back to Oct 2011 which I seriously doubt, you will still be eligible for the visa. I think if ever they do retrogress it will be closer to mid 2012. My PD is April 3, 2012. I am very confident that my case will be completed in mid August and IL should be in October, and my wife shouldn't have any problems getting the visa.

Plus the fact that they approved a lot of 2011 filers is really totally irrelevant. As they had mentioned in their statement on the August visa bulletin, their intention was to garner more demand in this category, by encouraging people who have not filed under this category to do so. Approving the existing people in the que tells us absolutely nothing in terms of how much new demand has been generated. For that you will have to figure out somehow how many i-130s were filed for f2A.

Got reply on my supervisor review letter, which just made me confident that it doesn't work as "speed up reply" feature. It took 15 days, the same time frame as for my first letter.

Also, got RFE for AOS package. Guys, make sure your joint sponsor or household member (i-864a) put adjusted gross income where it's asked (line 11 for i-864a, not aware about other forms).

Should get DS3032 accepted tomorrow

For 1040EZ it should be adjusted gross income, for 1040 it should total gross income

It says specifically in the Instructions to i864 document - luckily I read that b/c my joint sponsor file 1040EZ for 2 years and 1040 for one year so I had to change that since I sent the past 3 yrs tax return transcripts to them in my AOS.
