F2A is the category for Spouse and Minor Child of Lawful Permanent Residents.

You've got things mixed up. Not all F2A beneficiaries can adjust status in the US. You have to be of legal status in the US by the time your F2A priority date becomes current in order to adjust. If you are of illegal status in the US, you cannot AOS via F2A.

I believe we are talking about people that are eligible under F2A. Not about their legal statuses. It is obvious that only applicants with a valid legal status can do AOS.

As you mentioned spouses and children of LPR are eligible to apply through F2A and no one is differing on that.

08/02/2013 - AOS packet sent via Express mail (I-485, I-131, I-765)

08/12/2013 (day 8) - Received 3 NOA's by mail (I-485, I-131, I-765)
08/16/2013 (day 12 ) - NOA for Biometrics appointement. Date set for 08/27/2013

08/21/2013 (day 17) - Succesful walk-in Biometrics
08/27/2013 (day 23) - Biometrics appointement (Original)
08/27/2013 (day 23) - I-485 status online changed to "testing & interview"

D. VISA AVAILABILITY

FAMILY-sponsored:

F2A: This category has become “Current” for August, and is expected to remain so for the next several months. This action has been taken in an effort to generate an increased level of demand. Despite the fact that there are large amounts of registered F2A demand, currently there are not enough applicants who are actively pursuing final action on their case to fully utilize all of the available numbers.

hi dears,

an urgent question:

I have an attorney responsible for my case, then should I do anything with DS3032 (either by mail or email)?? or it is just dropped from my case because of G-28 (attorney form)?

Thanks with best wishes

no need to send DS3032, your lawyer is automatically become your agent. unless you fired your lawyer.

my husband use a lawyer too at the beginning filed I-130, just to fill up the form, still have to sent G-28, so when we got approved USCIS send email and mail to my husband and our lawyer.

I am sorry that you received this reply. Maybe someone who is new at the NVC processed your wife's COA and did not realise that an email COA can be accepted from all countries? Your wife could try resending the email, this time with "For supervisor review" in the subject line.

Agent Jesus sent an email on July 9th that my choice of agent submitted by email was accepted and processed. I did not do anything in the meantime...so first agent rejected, someone else picked it up and processed it...

Today we got the IV bill, so things are back on track eventually :)

My AOS pack is ready to return...I'm in Europe currently, but going back to US next week, so will post from there.

I'm assembling my IV packet now, is it necessary to write the case number on all civil documents including visa photos?

If yes, can I use pencil or black ink?

Black pen would be fine writing your case number on TOP RIGHT CORNER of your IV DOCS.Use pencil to write Beneficiary's full name,Date of Birth and case number on back side of the IV Photos.

Good Luck!
