You have to wait for i-130 to be approved first!

August Visa bulletin has F2A Category Current. can we start NVC process while I 130 is pending or we have to wait till approaval?

Ok I have done as you suggested as well.

When will I hear back from them?

Thanks

Shabber

you can do as the representative told you but that isn't really necessary. you can follow the format as shown in the link provided. That's what I did and I believe other members have done the same. hand written signature is not required for DS3032............... It's up to you.

I want to find out what are the things I need to send to the NVC once they approve my DS3032? My Spouse is in the F2A category so we don't need any Petitioner Documents.

This is what I think I have to send so far, please correct me if I am wrong.

A. 1. Affidavit of Support from me

B. Civil Documents including

1. Original Registered Marraige certificate and its Original Certified Translation

2. Original Birth Certificate of my Spouse

3. Police Certificates

4. Photograph of Biographic Page of Valid Passport

5. 2 Identical Color Photographs per Requirement

Yes with the DS230 signed by beneficiary and don't forget the photocopies of the civil documents.

I think that is about it - I just need to know 2 things

1. When do we have to give the pictures and other proofs of the marraige being bona fide - at Interview

2. My wife doesn't live at home in Karachi, Pakistan although her home is still there and her mother and siblings live there. She works as a doctor at a university hospital and lives in the Hostel women's dormitory for most of the month. That hospital is not in the area where my wife's home is. So will she have to get an additional police certificate from that area as well or will one from her home's area suffice. My gut feeling is that only one will be needed the one from her home area.

This is country specific. If there are various local police offices and one keeps the record of only one particular area and your wife doesn't live in the same area then she might need separate PC. As I told you it is country specific, you can find more here: http://www.travel.state.gov/visa/fees/fees_3272.html. Also, someone from your country who had already gone through the process can answer this better.

Also lastly, should I wait until they send me a notice stating that I should submit these things or can I do so before hand referencing the case number?

You have to pay the bill for AOS and IV to start submitting your documents. You must have got the email about how to proceed and how you can pay your bill.

Check your invoice here: https://ceac.state.gov/CTRAC/Invoice/signon.aspx. and can see if your AOS bill has been invoiced. If yes then pay the bill then you can send your AOS package when it shows you bill is 'paid'.

Please advise - Thanks

It generally takes 2 weeks. When your DS3032 gets accepted. Your IV fee will be invoiced. Then you can pay your bill and send your IV package.

There are immigration forums that mention I130 can be filed concurrently with I485 and AP,EAD documents with the PD current.

That means we should be able to file I485 and EAD, AP documents with pending I130.

"Priority dates for August have been released. The F2A category becomes current, meaning combined I-130/I-485 filings possible."

"C" means current, i.e., numbers are available for all qualified applicants; (from Visa Bulletin)

If there are sufficient numbers in a particular category to satisfy all reported documentarily
qualified demand, the category is considered "Current". For example: If the monthly allocation
target is 3,000 and we only have demand for 1,000 applicants the category can be "Current”.

is this mean we, f2a category treated like spouse of USC? no need to wait priority to be current?

and what is I-485? my case is in nvc already, waiting to be case completed. should I apply for this I-485 too? pls info. thanks

I-485 is only for those adjusting status in the US. It is not for those who will undergo consular processing.

F2A will not be current forever. It will be current in the coming months as very few have completed their cases at NVC. Majority has just been approved by USCIS and will still go thru NVC.

Hello

Please don t panic, who is talking about I-485 in a F2A visa?

What Is the Purpose of Form I-485?
This form is used by a person who is in the United States to
apply to U.S. Citizenship and Immigration Services (USCIS)
to adjust to permanent resident status or register for permanent
residence.
This form may also be used by certain Cuban nationals to
request a change in the date that their permanent residence
began.
If your case is already in NVC, you can just wait and hope/pray for case completed and IL asap.
Current just means there is enough visa to supply all the actual demand.
Good luck.

aaah ic... I thought we are now treated like spouse of USC with no PD.

so basically once our case is completed in NVC we can get I/L at anytime, no need to wait to be current again rite? since VB august is current for all f2a category.

F2A is the category for Spouse and Minor Child of Lawful Permanent Residents.

You've got things mixed up. Not all F2A beneficiaries can adjust status in the US. You have to be of legal status in the US by the time your F2A priority date becomes current in order to adjust. If you are of illegal status in the US, you cannot AOS via F2A.
