My husband (Canadian) and I filed our adjustment of status in February through a lawyer. We received letter that everything had been accepted and we received our appointment letter for the biometrics testing today. My husband was here on a student visa that expired a few months before we got married so now he is an overstay. We live in Texas and when he went to go get his drivers license after it had expired he was denied. He has no license or state issued ID but he still carries his expired DL. He has his social security card but that's it. His Canadian passport expired as well although e does have his cedula from Guatemala (country of birth).

Would we be able to still do the biometrics testing without any form of valid ID except a cedula? Everything has been done using his Canadian citizenship not his Guatemalan citzenship. Our lawyer made it seem like none of this would be a big deal so now I'm thinking he was wrong.

I can't answer for certain, but I would think it would need to be a valid passport or ID issued by the US. If I were you, I would go ASAP to the nearest Canadian consulate and get his passport renewed. Many countries also can issue a temporary "extension" of your current passport- I don't know if Canada does that though.

b) Current and valid DHS immigration documents with photo: I-766 (EAD), I-551 ''green card'' Naturalization or Citizenship certificate, I-571, Refugee Travel Document.

c) Current and valid US Passport, military ID, other US Government issued photo ID.

The following documents are not acceptable ID forms to access a Federal Facility, but MAY be allowed with supervisory approval. (If these IDs are all you have please call ahead to seek proper entry pre-notification: 402-633-4025)a)Matricula Consular

Just googling USCIS and "valid ID" I found this:

Try to do a walk in for biomentrics before your appt with cedula and expired ID. See what happens. if they refuse entry call explain the situation and see if you have to postpone until he renews his canadian passport

I searched here and through Google and I was never really satisfied with what I found. I only have a valid Matricula and an expired passport from when i was 10 years old. So i asked my husband to ask the immigration firm that he internships at and they told him that they should accept it but she preferred that i use a passport.

When I went last week to do my biometrics they took my matricula and didn't have any problems.

3/11/13 Received NOA1 hard copies

3/15/13 Received biometrics appointment for 4/03/13

5/03/13 I-765 Case Status updated to "Card/ Document Production"

5/11/13 Received EAD!

Thanks for the answers!

I'm getting a lot of different answers in my research so we will probably do the walk in scenario or get on the phone Monday morning and start asking questions.

Walkin has also the advantage that theAOS will go faster. There are different opinions here wheather walk in speeds up the process or not. In my case I felt that it did because my greencard was approved in what I consider record time .

Ok for those who might have this issue I wanted to update my post:

Lawyer said: USCIS "expects" people to arrive for biometrics with expired documents. It's not really a big deal apparently.

USCIS said: They have no official policy on whether or not you need valid ID and it's up to the officer.

I am not sure of this, but I don't think a walk-in will allow you to ask many questions. They will either reject you, or accept you in. But either way, it's not like it will speed up the process. I think at least. I think if your husband got a new passport (or a temporary) than he would be safer. If no RFE or anything comes along you'll have your green card in two months (at least, mine took two months). Good luck!
