Hi

I came to America last November with all hopes and dreams of marrying a woman who I thought I knew and loved dearly (I still do)

I arrived on a K1 visa.

We married and started the process to adjust my status. I got my work permit approved Febraury 15th and have still been waiting for the I485 to be approved.

January our relationship took a turn for the worse. My wife became very angry and anything that I said or did I was put down or shouted at. We were living with her parent. End of February I was thrown out of the house. I never was abusive in anyway or acted improper. I am a regular Church goer and try to treat everyone equally.

I have started work.

My wife then asked me to give her money (10% of my income) and she would be happy to remain married and help me stay. She then used this as a threat to make me do whatever she wanted, so she could have it all her way.

I have refused to give her the money as I don't think that is fair. So she says she has called USCIS and informed them that we are separated and she is going to get a divorce.

Where does this leave me?

What will USCIS do?

Can I claim abuse by her?

Please help, since getting here the whole affair has been a nightmare and these last few months have been the darkest of my life. There has been so much uncertainty and it continues.

Any help/ advice or just someone to tell me what will happen will help.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

1. Well if she has withdrawn her support your AOS will be denied and you will need to leave (within 30 days usually).

2. As above. Depends on if she withdrew her support. If she didn't and you get approved without interview and BEFORE divorce, you're fine. If you get approved AFTER divorce without interview, you will need to return the GC because you were approved incorrectly. If you get called for interview she would need to attend or you would be denied.

3. You weren't abused. Your relationship broke up. You were thrown out of her parents house. you could TRY if you wanted to, but I think it would be pointless because you aren't being abused and weren't abused (not based on your OP).

Personally I would wait to see what happens with AOS while I saved furiously for a flight to return to my home country. Then if I got the GC, great, if I didn't then I would have the funds to return to my home country and would leave within the timeframe they state on the denial letter (to make sure you don't get overstay issues and thus problems returning as a visitor).

These sorts of stories chaps my hide. After all the grueling BS that USCIS and DOS puts us through, then this.

Good luck mate. At least you're from Jangdon so if you have to go back home it will be relatively easier to set up again.

PS: The devilish fiend in me woudl walk around with a hidden tape recorder and bait her to offer you green card for money. (Check the legality in your locality for Gods sakes).
