Hey y'all!

my wife (petitioner) and I (principal applicant) are trying to figure out which of the I-864 affidavit of support forms my wife should file. Our problem is that my wife does not have the 40 quarters that she is required and has very low income as she in college and dont work much. Do we need to get a sponsor on out affidavit of support to be sure that the case may be approved. I have sufficient funds and will be financially stable, secure for the next years post immigration, can we go ahead and fill out the regular I-864 and then add my funds as and then count on that it will be satisfying for the NVC?

This is our only hold up and we really need some advise and help, really appreciate y'alls help! have a blessed day!

Wife - I-864 with her income (however small).

You- can add assets (cash in the bank) to it. Read about the valuation of 3 and 5 times the amount in cash to the yearly income requirement and see if you qualify, by adding your assets to your wife's income. The instructions also talk about houses you own, etc, but I am not sure if foreign property counts, so you can check that out.

If it doesn't add up, then you get a co-sponsor. Wife still fills out I-864 with all supporting documentation.

Unless you work for an American company in Denmark and are being transfered to that same company in the US upon immigration the USCIS won't care how much money you have in your pocket when you move. They care about future employment. (even 6 digits can disappear quickly from a bank account when it comes to buying a house/car, etc.) If your wife is unable to support you through the I864 then she can find a relative or good friend who can file as a co-sponsor. She'll still have to file the form along with tax returns, but a co-sponsor with a good income will assure the government you won't become a public charge.

-(then fiance) B-2 tourist visa denied due to lack of strong ties to Germany in Sept. 2010.

-B-2 tourist visa approved on Nov. 16, 2012!

-Extended German residence permit obtained Aug. 23, 2014. (to qualify for DCF)

-Husband's new German passport picked up Aug. 28, 2014. (Old one expires 2015)

-I-130 packet sent to Frankfurt (DCF) Aug. 29, 2014!

-NOA1 issued Sept. 9, 2014 (received Sept.13)

-RFE regarding evidence of bona fide marriage received along with NOA1

-RFE reply packet sent to Frankfurt Sept. 30, 2014

-E-mail response (NOA2) received by USCIS Frankfurt on Oct. 23, 2014 (Petition APPROVED Oct. 20!!!) :dancing:

-Paper NOA2 received in the mail Oct. 29, 2014

-Case number assigned by IV unit Oct. 30, 2014 (Received by email Nov. 3)

-Paper "Packet 3" arrived in mail Nov. 4, 2014

-DS-260 and Document Delivery Registration submitted to Frankfurt Nov. 4, 2014

-Mailed in priority date request found on Packet 3 to IV Unit Nov. 5, 2014

-IV ("Packet 3") package sent to Frankfurt Nov. 17, 2014

-Medical completed by Frankfurt panel physician Nov. 17, 2014

-Received "Packet 4" via e-mail Nov. 20, 2014

-Interview booked for Dec. 3, 2014 (booked Nov. 21, 2014 after email authorization received)
-Visa approved, issued AND picked up by the courier all within 7 hours, Dec. 3, 2014

She doesn't need 40 quarters of work, you need to re-read that form. That 40 quarters of work by the immigrant releases the sponsor from their obligation to financially support the immigrant.

You will need quite a bit of assets to make up the difference, as others have said, it is 3x the difference between her American income and the 125% poverty line. I highly recommend a joint sponsor if you are borderline or below.

It isn't just the NVC that you have to satisfy, but also the embassy. :thumbs:

If your liquid funds are 3 times the income shortfall, sure. 40 quarters for her is not relevant to your situation in any way.
