VISITOR VISA ALONG WITH I-130

Hi I have filed form I130 for my wife on feb 21st 201. we have family function in Jun 2013, and would like to invite my wife over for it. will i be able to apply for visitor visa for her to usa from india. what are chances of her getting visa.... she has active job and wants to come only for 10 days.

Slim, especially with an I-130.

If she can prove strong ties to India then there is a chance, the more ties the better (property, family, etc.)

With a pending I-130 it's going to be an uphill battle, but at the end of the day any possible denial will not have any effect on the immigrant visa.

She would apply on her own. You have nothing to do with it. As soon as they see she has a pending petition they will deny it because that alone indicates immigrant intent. However the only way to really know is to have her apply.

If she can afford to lose the money, she should definitely try. I am in the same situation, have an i130 pending and applied for visitor visa. I had my interview on Tuesday and my visa was approved. However, I must say that the CO was going to deny it first, but I eventually managed to convince her that I will come back. Although your wife does have an intent to immigrate, she has absolutely no interest in staying there illegally on a tourist visa and ruin her chances of getting an immigrant visa legally. She should tell the CO interviewing her that she is fully aware of that. She should also emphasize that you are doing everything by the book (she did not apply for a visitor visa before the petition was filed and not she did not go to the USA on a tourist visa and got married there, although she could have done and many people do it, because it is much simpler). In addition, she should take a lot of proof of ties to India (job contract, letter of employer about when she is expected back to work, bank accounts, lease, etc.)

It is possible. I know a lady whose senior father came to visit 2 or 3 times while his I-130 was pending. You just have to prove that you'd rather go the legal way that you already started. Not sure how, though. There's never a sure way for a visitor's visa.
