My fiancé filed the K1 visa in January 2013.

We are patiently waiting but I have some questions regarding bringing my 21 mth old daughter to the US.

Her name was also put on the K1 visa.

Her biological father has nothing to do with her and hasn't for most of her life. He isn't on the birth certificate either. I'm curious as to what information I will need from him (if any) for the interview, in order to have her visa approved. Is there a way I can slip through the interview without addressing this concern.

I have more questions but ill just start with the basics. If anyone has or has had a similar situation and can offer some information it would be beryl appreciated.

I had to present all the evidence showing that I have sole-custody of my two children. Even though I have sole custody, my ex has access for visits. My court paperwork says this much. I also had a letter from my ex stating that he knew we were moving. I did not have to present that letter but had it just in case.

USCIS - 40 DAYS
2012-10-30: FedEx delivered I-130 to Chicago Lockbox Mail Room
2012-11-01: NOA1 by email - MSC

when does your daughter turn 22 ?

I'd suspect in a little over 20 years as she is 21 months old. ;)

Didn't notice the month part Is the bio dad on the birth certificate. If he is you should see if he is willing to allow the child to come, most sperm donor type fathers are more than happy to think someone else will be raising their child.

This will not be over quickly. You will not enjoy this.

If the California service center keeps up the way it's been, it's possible the daughter will be turn 22 before the NOA2 is issued, making it very hard to bring her to the US. :lol:

Since he's not on the BC there I'd nothing you need from him. He's not the official father and out of the picture

My stepson has no father listed either and there were no issues.

I also have 3 children who will be coming with me to the US. The father of my kids, who is listed on the birth certificates, wont allow us to leave the country let alone get passports. If he had of shown up for the custody hearing he would have known that my lawyer put a clause on my custody papers stating that I have "Sole Parental Responsibility" of my 3 children. I have since then gained passports for my children without him knowing or consent. I can't see a problem when it comes time for me to move (if everything gets approval). I will carry those papers with me.

Me too, when i applied for my son's passport, they asked a court order which states that the custody is mine. They asked original copy of it, and they processed right away with no hustle. I don't think i need anything from my ex husband in regards to my son's leaving the country. After all, he doesn't give any financial support as ordered by the court, not even a centavo or a dime. He should be thankful, that i am letting him see my kid, as i am thinking that he has a few months left to see my kid and i am giving him a favor.

Yeah, my children's passports went through without any hassles also. It's a good thing you at least let the father have visits. I wish my children could at least see their father, but loads of court orders and he was the deciding factor as to if I should move with my 3 kids or my fiance come live here in Australia. The father of my kids has already tried to kill us once, I think it's the best choice to leave this country and start a new life with my fiance who adores me and my kids :) True Love does exist (L)
