Transferred to San Diego Field Office when I live in Belgium

Timeline

Just spoke with a Tier 2 and she said my case was transferred to the San Diego Field Office, last week when I called I was told that my case wasn't transferred. She said it looks likes there's an RFE coming and they want to interview me. I've been married for 6 years and lived in Belgium with my husband the entire time, but I mentioned both addresses on my application, our Belgian address and the address we will move to in the US.

Why is it so difficult to just do a simple thing???? I submitted proof of our US daughter's birth 5 years ago and a bank account. Isn't having a child together and living together for 8 years enough proof of a relationship?? Frustrated!

This has Nola123 written all over it. The same thing happened to her - she lives abroad with her husband and daughter (Denmark) but for some reason her case got transferred to Hartford, and everything really went to hell from there. She eventually had to refile the whole petition. I would definitely send her a message. I'm sure she'd be more than happy to give some advice.

Do not believe USCIS, bunch of liars and lazy people. First time when I called they told me my case is still at NBC and after week when I called they said it was transferred to Local office in JAN. Answer suppose to be same because I made both the calls in March. I am really frustrated with the whole process. These people just care about illegal immigrants but they have no sympathy and care for USC. Nola123 had similar situation, I suggest you see her blog.

You need to make sure your case is actually in San Diego b/c you can't trust operators at USCIS, even Tier 2 ones. Do you have someone who can make an infopass appt for you? They can go check on the file. If it truly is at San Diego I suggest you go straight to congressman/senator, don't even try to go through avenues in USCIS, you'll waste time and they'll just screw up your file even more.

Lastly, call USCIS and ask them what address they have on file for you, the petitioner. If it's the Belgium address there's very little probability that your file was sent to San Diego and the USCIS operator is an idiot. If the address is in the US, then you might have a problem :(

Yeah, they had the US address, even though I clearly stated my job and current address were in Belgium.

If they are actually thinking of doing an interview, there are two avenues to go by:

The Ombudsman - they got back to me in a week or two and gave me a fax number to send in a change of address form so that we could have the proper foreign address

The foreign field office local to you in Belgium - might be able to take your case on, who knows?

There is a good chance that if San Diego isn't as incompetent as Hartford that your case will proceed normally, although I would send an email to OLUInquiries@dhs.gov with your issue.

I received my RFE now from the Chula Vista Field Office for my certified marriage certificate. The thing is, I submitted this (of course, it's the most important document!) I made a copy of every document I sent, and this was included. So, they lost it! I've requested a new one and will send it again. Hopefully, they won't lose anything else in the meantime! :wacko: :wacko:

That sounds like an easy fix. Unfortunately parts of files are often lost by the USCIS. :blink:

Sorry to hear about some of the problems you are facing with the San Diego and Chula Visa Field Offices. I appreciate you sharing your experience. Your case seems to be moving fast which gives me hope that mine will as well. My field office will be Chula Vista as I am a resident of Chula Vista. I'm hoping we are approved in 5 months like you guys, but hopefully they won't lose any documents -__-

We got approved on May 9th and the NVC confirmed they received our approval this week, no case number yet. So, good luck! Hope it goes as well for you too!
