You have to meet in person, obviously.

Then, he or joint sponsor will have to meet the income requirements. If he has no other children, then he or the joint sponsor will need an income of $34462.5 or assets 3x that amount.

Be aware that you and your children will not be able to receive benefits in America for quite some time. You will need to provide health insurance and there will be no safety net. I'm a little concerned about you guys leaving England.

**** Moving from K1 fiance visa to General Immigration as OP has not decided on a visa yet *****

You can't just go and marry him and stay, no.

To file for a K1 fiance visa you need to have met in real life within the last two years. To file for a CR-1 spousal visa you need to be married, so also have met. So first, you need to figure that out. There are often cheap flights in the off season- it is probably cheaper for him to fly so you don't have to arrange child care etc. He does not need to stay long, just a few days so you can get together, take a few photos, and be sure to keep the boarding passes.

Once you have met, assuming you still want to spend the rest of your life together, you can either get married and then file for the spousal visa (advantages that you can travel and work immediately once you arrive) or the K1 fiance visa (it's more expensive and you can't work or travel for a few months once you arrive in the USA, but if the three kids are coming with you, it may work out not that much more expensive as they are derrivatives).

For the financial requirements for the visa, if he doesn't make enough money and has no assets (savings, property, 401K etc), he will need to get a co-sponsor; ie a US based greencard holder or US citizen who will stand gaurantoor for you.

The other potential stumbling block is whether the father of the three kids will allow them to leave the UK?

The above post is correct and I agree with concerns. You'll have no way to get support from the government, and the USA is even less prepared to help people below the poverty line than the UK. You won't have the NHS anymore, either, and medical stuff out there is very costly.

Regardless, these are the guides on your options should you actually meet him.

You can either get married now either in the UK or the USA, but then you need to return the the UK while he files a petition for you as a CR-1: You'll be able to enter when that's processed and live there. http://www.visajourney.com/content/i130guide1

Second option is he files a K1 petition for you as his fiance. This will allow you to legally enter the USA, marry him and then remain: http://www.visajourney.com/content/k1guide

The main thing you need to do to fulfil the criteria for either visa is *actually meet*. You won't get a visa without that.

Then secondarily, you'll need to find someone in the USA to co-sponsor with your american partner.

The task of coming from another country to be with our loved ones (for a visit or for residence) is not easy for many of us. Whether you're married when you start your visa journey or you are engaged, it is an expensive journey. Then, the married life begins with the two of you together and any children if applicable. It is possible for you to be together with the help of a joint sponsor, but any sponsor must commit to helping you for a long time if needed. The best thing to do is plan the best you can financially. It is the burden we all must deal with. Two requirements must be met to immigrate as a fiance/e: you must have met within the 2 years prior to filing, and the US citizen must sponsor (or have a joint sponsor) the foreign beneficiary with an income of at least 125% of the poverty level for the respective household size. Without being able to do either two, the most you can do is plan to make a way for these two things to happen. Good luck!

hi, I´d like to say something from one woman to another... I understand that your life seemed dark before you met him and now that you´re in love you feel like he is the solution to all your problems and the key to your happiness.

I am not saying that he´s not. But you can´t be sure as of yet. Make sure you meet him in person and possibly stay with him over a longer period of time, for example on a Visa Waiver (I am assuming people from the UK get those too).

That´s how I did it and even though I thought I knew my boyfriend (now fiance) very well after over a year of talking on skype, I learned so much about him experiencing him in day-to-day situations, flaws and all. In our case it worked out fine and we realized that we are indeed a match. But there could have been red flags that I would have totally missed if I had never spent that time with him.

All I am saying is, don´t rush into marrying him and moving to the US. It has turned out to be a disappointment, a nightmare even, to some folks! If not for your own sake, you should think twice for your 3 children´s sake!

Good luck!
