1. In Nebraska, you don't need a birth certificate to get a marriage license. Your passport will work fine.

2. For a marriage license in Nebraska, a Social Security number is "requested." It's not "required."

3. As a K-1'er, you should not have filled out part two of the DS-230. That might be what's causing the problem with the SS office.

In 2009 they asked to see my birth cert and passport to prove age of consent and birth place. They turned away another couple because she did not bring her birth cert with her.

Some consulates do require K1 visa applicants to fill out the DS-230 part II. The German consulate does:

"(...) Please download and complete the original form DS-230 Part I & II, (...)"

In 2009 they asked to see my birth cert and passport to prove age of consent and birth place. They turned away another couple because she did not bring her birth cert with her.

Their rules may have changed since 2009. Their website clearly spells out the current requirement.

However, it's a good idea to play it safe and take your birth certificate along.

Just got back from the county clerk and got the marriage license. The lady didn't ask about anything except the 2 id's and she photo copied them and gave us a packet of info after going through it with us. So I guess we'll stop by a CBP office and see if we can fix her name there and whatever else they did. Then we'll get married very soon. We'll got back to the ss office after we visit the cbp.

Which two ID's did they ask for? Were the two ID's "required" or simply "requested?"

They required a form of ID, we showed them our passports. Her's had the I-94 in it and she scanned the page that had the american visa sticker on it. I brought a copy of her Birth cert but they didn't ask.

On the handouts in the clerk's room it said the social security number is "requested", the lady didn't say anything about me leaving her's blank but she saw the passport at the same time so she probably just knew what to do. There are a lot of mexican people here that apply so I'm sure it's not the first time she's seen someone without a ssn.

They spelled her name wrong too, they put her middle name in with her first name "SisaMoana" instead of Sisa Moana. The SS office guy told us that when we were there the first time.

Should we just let it slide until some later less time sensitive date to change it?

Here's what I'm thinking right now:

1) Friday (...today) - go get marriage license and schedule marriage for asap.

2) Either CBP to fix the name or Back to the SSA office again...but this time I'll just print what to ask them from the SSN howto and bring it.

The ss office guy seemed pretty convinced he couldn't do anything and had to wait for something to get mailed to us or something...

You think the SSN howto k1 instructions will get him on the right track?

(if you suggest the CBP fix thing is this the right location?)

#1 : You GOT your marriage license (awesome) now you can GET married #1

(your fiance has a SSN. change the name later... is she changing her name? Taking your last name?)

After you get married, you'll get a marriage certificate. This is required by the SSA, for name change.

*I got my SSN 2 weeks after my POE, got married. Received marriage certificate weeks later.

Received SSC #1(maiden name) & applied for name change that day. Handed over #1 card. Received married name SSc days later.

Easy!

Getting married is #1 and you're on your way!!

repeat for emphasis -

she has a name problem in the SAVE database system. Someone at the POE , past the POE intake, mucked it up.

CBP can fix this, but must go in person. must have SAVE record matching what's in the VISA for name. I say name, but it might also be the A#, where a digit got transposed, so look at both bits o data at CBP - VISA Name and A#.

Once it's fixed, wait one more week, then get into SSA office again and apply in VISA name. SAVE records update in batch mode, is not instant for SSA viewing. I wish it was, but it's not.

Insist the SSA employee do a lookup in SAVE system when yer there. If the employee seems slow-brained or dim-witted, ask for supervisor early on. If still some problem, you'll hear magical evil words of 'Need DHS verification' and that's the kiss of death. Withdraw the application, make sure the supervisor understands you are NOT applying that day, and walk away. Come back in another week, as the SAVE db update didn't 'take' yet.

Thanks Darnell, we'll go to the CBP on monday and I'll post an update then.

Also, our POE was Guam (due to a multi-stop flight). That won't mess anything up or slow anything down will it? No waiting for paperwork to ship over seas?

na - won't slow anything down, at all. There be clerks behind the scenes, that you can't see at the POE, who's sole job is to create SAVE database records with the casefile in front of them. Casefile travel not matter - as SAVE database is some electronic thing.

OH - i keep forgetting - is quite possible that someone got confused about the SSN card, as well - cause the SSA employee at your local office has FOUND SOME RECORD of an employment-related SSN application prior. Is it linked to Part II of the DS-230? Maybe, maybe not....

So here's what we did.

We got married, then filed for Adjustment of Status.

I actually emailed the department of homeland security and they called and left a message on my phone describing that I need to just file the AoS and do the SSA/N later after we get the green card in 3 months or however long it takes.

I for some reason was under the impression it was possible to get the social security number before the green card. :wacko:

So we compiled the forms and mailed them. Hopefully got it right but I'll post it here to see what you guys say. I just did what I saw others doing that they posted and checked things along the way. I also looked at he instructions to double check and it seems right. (It's mailed already so hopefully it's good enough)

Here's the cover letter (minus the addressing at the top and formatting)

I-485 Application to Register Permanent Residence or Adjust Status

My eligibility is based on admission as the fiancé of a U.S. citizen and subsequent marriage to that citizen within 90 days of entry (K-1 Visa).

I paper clipped the tax forms inside the bulldog clip of everything. I bulldog clipped the 2nd forms and just left the other with a paperclip. Stuck it inside a brown envelope and then inside the usps envelope and mailed it priority with tracking for $6.
