Contact the Embassy as soon as you can and try to get a reason why she was denied. You need to do this before the petition is returned to the NVC/Homeland Security. You may be able to explain things if there was some kind of misunderstanding or maybe submit more paperwork. Your petition will be sent back to the National Visa Center/ Homeland Seurity which could take months to arrive. After that it will takes months to review and they are supposed to send you a NOID, Notice of Intent to Deny your petition. You have a certain number of days to respond. Basically they will tell you why the Embassy denied you and you have to prove that the Embassy made a mistake. If USCIS agrees with you they will resend your petition to the Embassy for another go round. THIS IS A LONG LONG PROCESS. I would advise you to try to head it off and call the Embassy right away to try to find out if you can fix it before the papers are put in the mail back to the U.S.

First you need to find out why the visa was denied. Your fiancee should have been given a reason, in writing, although it may be terse and not understandable. Perhaps nothing more than a reference to the section of the INA on which the denial is based.

Then you, preferably she if possible, should go have a consultation with a US immigration attorney who concentrates on family-based immigration. Preferably one who has experience with the particular consulate in question. From knowledge of the consulate, review of the materials submitted with the visa application, and discussion with your fiancee about what took place during the interview, the attorney may develop an insight into what caused the problem and have suggestions as to what to do next.

After two days of interview, my fiance was denied travel visa. I am just numb. I have yet to see any paperwork, but wish to do what I can to reverse this decision before it becomes too fixed in stone.

What discretion do they have at interview stage to deny visa when all paperwork has been presented on K1? What course is advisable from adverse interview decision?

Blue Surf your original post was not clear and I was not sure you were getting a visitors visa while waiting out the K1 or it was the K1 interview. Now I see it was the interview for the K1. I am sorry to hear that you have a denial and yet again your post is sketchy since you do not have enough information.

1. Contact the embassy ASAP and see what is the denial? Is it a 221g temporary for needing more evidence or she has to have her name cleared via one of the many agencies and are awaiting it?

2. If it is denial out right talk to the CO and try to find out what you can do to persuade them to give you time to get new evidence or whatever they need? Maybe another interview if necessary and try to keep from having the files returned to the USA. It will take a long time to get back and go thru the NOID motions.

4/22/2008--He was approved for the Visa 2-3 weeks until he recieves it in the mail lets hope so!!

Im so sorry about this. I hope that you can sort things out and have a turn around.I will keep you in my prayers.

So very sad to hear. I just realize something very important......we will fight with each other on this

forum BUT when a member of the Vj family is in trouble the support is strong....I like that.
