K3 AND CR1 APPROVED SAME TIME !?

Timeline

You are either married or not. If you filed for both you misreprsented your status for one and may be in for headaches ( material misrep is a lifetime ban ) figure out what your marital status and continue with the correct visa.

This will not be over quickly. You will not enjoy this.

You can't legally file for both. K3 is for an already married couple who wants the beneficiary to go to the States while the IR-1/CR-1 is being processed (though this visa is very outdated and VERY rarely granted nowadays), and K1 is for fiances, meaning they're not. If you filed for both, like already mentioned, you could be in for some major problems.

K3 approved April 1,13 and K1 approved april2,13 Which do I have to go with and or what is faster ? Please help!

Very misleading title. Well you didn't apply for A K3 and K1. You sent in a I-129F and I-130. They both are going to NVC. In about 99% of cases the I-129F will be administratively closed and no further action will be needed by you.

You need to decide which you want than notify NVC which route you want to take.

No you didn't do your homework. You have not filed for a Visa. You sent in a petition. One is simply spousal visa I-130 you file first. Than your sent the I-129F which goes with the I-130. The actual K3Visa issueance wouldn't come until the Embassy Interview if it was to happen. A married person would never be issued a K1.

So you have to make the choice if they don't at NVC go the spousal route and save money or go the I-129F route.

We all have done our homework. What you did was send the I-130 petition that can lead to a CR1/IR1 visa. The addition of the I-129F is what makes it lead to a K3 visa. However, the I-129F is most of the time closed at the NVC stage due to an approved I-130 that arrives with or before the I-129F. Even an embassy or consulate may close the I-129F and the K3 visa path if there is an approved I-130.

Confused... K1 is for non married couples who wish to bring their fiancée to USA to get married.... K3 is for married couples to bring spouse (usually filed with cr1 visa...most I do not understand how you can have both? Either you ARE or ARE NOT married... This determinis what visa. Can you clarify?

11-30-09: GOT GREEN CARD in mail!!!!!!

Citizenship Process;

1/11/2013: Mailed N400 to Dallas Texas

3/11/2013: interview.. Approved

4/4/2013. : Oath! Now a U.S. citizen!
