K1 Jamaica to US - AOS, EAD, travel, follow 2 join

hello forum - I have not posted since we were granted our K1 in Kingston, my fiance came to Texas and we married Dec. 1. 2012. K1 has run out but I-94 active and filed 485 AOS and 765 EAD receipt dated Feb 6th, Had finger prints taken March. Got a RFI for more income support proof - they received my "thorough" response March 14th. I believe the National Service Center is processing us.

A few questions please:

1) anyone have experience close to mine with approx. wait time for EAD? I guess we get a letter next when that is approved and saying go to get the card at a local office??? about 60 days?

2) so if I am reading right - my husband cannot travel outside US (back to Jamaica) until the perm. residency is approved and we get his green card. which is around a year wait????

3) we want to bring the kids over eventually to live with us but probably not within a year of the K1 approval - so if after that time I guess we have to do a 130 process for each child (there are 5) - are they processed together? approx. cost? We listed them on our original approved 129F but listed as not traveling with at this time......

If you submitted I131 along with I765 and AOS, then your husband will most likely get a combo-card; a credit card sized EAD that also works as AP. With AP/EAD in hand, your husband can visit or travel and be let back into the US as long as his AOS is pending and the AP is valid.

EAD usually takes between 60-90 days. I'd suggest hoping for 90 days and get pleasently surprised by USCIS when it's approved earlier.

Your husband will get a letter for a biometrics appointment in the mail. Take that (along with ID) with you to the appointment. It usually takes about 1o minutes to have picture and fingerprints done depending on how many people are in ofcourse,

I'll leave your 3rd question to someone else.

Soo, in the right order..

1 - Receive letter in the mail with a biometrics appointment

2 - Go to biometrics appointment

3 - wait until status changes online or until receiving EAD/AP in mail

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

What is AP? I hear that used a lot. He already had his biometrics fingerprints early March.

We did not file an I-131 with our AOS/Employment Verification - I guess we can file that any time???

AP is advanced parole. That means your husband is allowed to leave and reenter the US without abandoning the AOS.

You can still fill it out and send it with the needed evidence AND a copy of NOA1 from AOS. That way, you waive the fee of it. When you've filed fairly recently, I'd definitely submit it in case there is an emergency in your husband's home country. Without it before the greencard, your husband will abandon his AOS by leaving. Just remember the copy of the NOA1 because that's the piece of paper that'll waive the original fee/cost og AP. It's the form I-131.

My AOS took a good 7 months. So I was thrilled to have both EAD/AP long before getting greencard.

Thanks Moomin. Great news today on the website it was finally an update - EAD card in production!!!!! will receive within 30 days it says.

so I should file I-131 while the AOS is in process and there is no fee - that way if he needs to travel he can and not abandon the AOS processing.

While it might be approved by the time of the decision of AOS, I'd still personally prefer to have AP submitted. Just in case anything you don't send it, you can also make an infopass appointment and bring proof(AOS NOA1, the emergency overseas) and supporting papers and ask for an emergency/expedited AP in case anything happens.
