hi everyone my name is mae..my story is im overstayed for a year now in usa..im from philippines..but i just got married but my visa just expired and me and my husband is wondering if im going to have a hard time getting an i.d i already have my marriage certificate..do they need my visa or passport even tho i show them my marriage certificate??

pls help .. thank you..God bless you all.

forget about ID until AFTER you have filed the Adjustment of Status paperwork.

Hello Mae,

You better first get a legal status in the US before worrying if you can get an ID or no.

On which visa did you last enter the US? When did your visa expire? When did you overstayed? Do you intent to live in the US?

K-1 Visa Timeline AOS Timeline

- Aug 31st, 2011 - Mailed I-129F package - May 29th, 2012 - Mailed AOS/EAD/AP package

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received

ROC Timeline

- May 19th, 2014 - Mailed ROC package to CSC

- Aug 8th, 2014 - Green Card received

N-400 Timeline

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.

- Now waiting...

IF you married within 90 days of arrival, the normal Adjustment of Status suits your exact situation.

IF you married after 90 days of arrival, must file I-130 + I-485 plus the other forms and a new medical thingie.

I am assuming you got married after the 90 days , past arriving in usa.

You said you just got married, so do you mean that you didn't get married during the 90 days after your entry with the K-1?

Can you give us more info with the dates so we can figure everything out and help you at our best?

- when was your K-1 visa issued? what is the expiration date on it?

- when did you enter the US with it?

- when did you get married?

yes i just got married last month i got here last nov.2011..my visa expiredmarch12 2012 it was issued to me on 22sep2011

Thanks. Your visa was a single-entry visa so it expired the day you used it. They must have stapled a white paper in your passport (known as I-94), with a stamp on it. The date on the stamp should be 90 days after your date of entry, which should be sometimes in February 2012. You overstayed starting on the date on that stamp.

Follow the VJ guide that Darnell gave you. You need to file for I-130 (your US spouse does it), I-485 and I-765 if you want to work while your I-485 is being processed. Do not file for I-131 which is a temporary travel authorization. You overstayed for more than 180 days so it would be risky for you to travel before getting your green card.

Mae, visa expiration not important, for a K-1.

what mattered was marriage inside the 90 days past the POE date.

You not do that.

is ok, just a different set of docs to file, to get a greencard.
