What is my best option?

Hello folks,

This is one of the forums where I found people seem to be responding to the questions. Will be glad if I can get some pointers or two.

I am a physical therapist working in the US since the end of 2009. My H1B was transferred once and is up for renewal now. I don't foresee any troubles with the renewal but you never know.

My employer wants to file for a permanent residency (green card) for me but I am not quite keen on living in the US on permanent basis. May be few years, get my doctorate and move back to my home country (India). Since pursuing doctorate while working is pretty difficult task, I was considering taking a break for a couple of years and then work for a couple of years before moving back to India. Something like, renew H1B now -> Work until Mid of 2016 -> Break for 2 years for the doctorate -> work for 2 to 3 years -> Move back to India. During my doctorate period, my wife will support me (She plans to get H1B next year and her H1B doesn't fall under quota).

Of course, I have not discussed this with my employer but in my shoes, what will be your recommendation to go about with the visas?

I don't see any problems until I get my doctorate because I think I can transfer H1B to J1 or H4 and study but working for a couple of years after doctorate could be a trouble.

You can get a GC without living in the US permanently, and you can give it up at any time. If you're looking at leaving around 2020 at the earliest, then a green card will open the most doors to you and you'll have freedom to work for whoever you want, instead of just someone who can sponsor you. If your current employer wants to file for a Green Card I'd go for it.

Your green card is for future employment not related to H1..

1. You can extend your h1..

2. File for green card -- your employer might keep it going after you leave him...

talk to a good attorney for the best option.. No harm in applying for GC imho

Do you even know what u are talking about employer cannot do a ####### with his GC and employer cannot keep his GC.

OP - If you want to study, than best option for you would be to go on F1 continue your school while your wife is on H1 and supporting you.

On F1 you can go to school full-tim and concentrace on your school.

Once you are done with your school you can go back on H1, work and than go back to your home country as you wish.
