Any Washington DC field office I-130 transfers?

Question 14: With the passage of the LIFE Act in December 2000 and the promulgation of
implementing regulations in April 2001, both Congress and Legacy INS announced a policy that
would, in theory, allow foreign spouses to join their U.S. citizen spouses in the United States
quickly and avoid the long separation associated with increased I-130 processing times. USCIS
has adopted a policy to adjudicate the K-3 petition (Form I-129F) and petition for alien relative
(Form I-130) simultaneously. This practice effectively eliminates the benefits of the K-3 petition
and frustrates the intent of the LIFE Act together. DOS takes the position that when the I-129F
and the I-130 are approved together, the beneficiary becomes ineligible for a K-3 visa and
therefore, proceeds with processing the immigrant visa application. Will USCIS reconsider its
policy to adjudicate both petitions together and implement a policy to adjudicate K-3 petitions
within 30 days in order to achieve the clear policy imperative announced by Congress with the
creation of the K-3 visa?
Response: The K-3 visa was intended to reunite families separated due to a backlog in I-130
adjudications. However, I-130s are no longer backlogged and are currently being processed in under 6
months. Therefore, USCIS does not, at this time plan to implement a new policy on the K-3 visa petition
process.
Hah, yeah rrrrrrright... so we all knew that K-3's have been out for some time now, BUT CLEARLY THEY SHOULD BE BACK IN WASHINGTON, DC LOCAL OFFICE!!! (and of course other severely backlogged ones). Perhaps they should reconsider... Ugh.

It is very possible that our case will end up in DC after all, and honest to God, I am TERRIFIED.

We will most likely be filing the week of 7/22.

I do not want our petition to go that mean, mean place... cray5ol.gif

Anyone has any good news here? I am keeping my fingers crossed for you all! :)

Ummm, ok.. so I see it is still possible to file for K3 together with I-130? Could someone correct me on that?

If so, would it make any sense for us to do just that, knowing what processing times in DC are?

The policy you quoted above was the policy of tying the two petitions together for them to be adjudicated at the same time. This was accomplished by pulling the I-130 from its place in the queue and placing it with the I-129F that was just received. However, that was when I-130's were exclusively adjudicated at CSC or VSC. Now with local offices in the mix, what I just stated may not apply.

If you want to try and chase after a K3, you would send the I-129F to the NBC after receiving the NOA1 for the I-130. I haven't heard one way or the other if the I-129F remains at the NBC and is adjudicated there or if it goes to the same field office the I-130 ends up at.

I have been reading more on the subject and- given how damn long DC is taking now- I think this route is worth considering...

However, I read about few cases where it actually slowed down the process.

I hope I-129F's are NOT transferred to local offices, though! THAT would be just pure nonsense

Hey all. I want to write my senators in Virginia about this nonsense to a) check on my case and b) request a solution to the backlog at the DC office. Can someone post a sample letter and I can change it around to fit our situation? I'm hoping that our senators in Virginia could do something about the backlog since the DC office is technically in Fairfax, VA. Maybe I'm too hopeful but I'll try anything. My husband and I do not want to spend our 1 year anniversary apart and at this rate I have a feeling we will :(

The senator you need to write to is Senator Mark Warner, just fill out the webform on his site here:

http://www.warner.senate.gov/public//index.cfm?p=HelpwithFederalAgencies

You will get an automated reply asking you to send a letter and sign a couple of forms they will send which gives them permission to look at your case and act for you, this HAS to be done and they wont do anything until you sign and return the letters.

Just put your case number details, your filing date, express your concern and wait.

I went again to an InfoPass. The IO I spoke with was much nicer and friendlier. He said that their office follows the timeline of the Vermont office. He said that this means they are on December or January and for me to make another appointment if I don't hear by Sept 1. Anyone prior to Februrary approved yet?

i went there last week .am december 2012 filler for spouse .they told me that they process the month of october .he told me you need to wait 2 more months .how they told you that ?i guess they just keep lying .

On Jul 1 my wife had infopass they said they are working on October. Now we are gonna schedule another on in mid-August to see where they are.

On Jul 1 my wife had infopass they said they are working on October. Now we are gonna schedule another on in mid-August to see where they are.

I am November filer and still no approval. Really suck with the waiting game. God I hope I hear soon from them this month will be our one year and we will be apart that really sucks.
