I-864 or I-864A?

I'm getting way ahead of myself probably, but I like to plan in advance for things. My fiance and I will soon marry and apply for DCF in South Korea. We plan on returning to the USA in February 2014. Although my income here would qualify me as a sponsor, I'm aware that I'll probably have to have a cosponsor due to the fact that I won't have immediate employment when we return to the US. My father is willing to do this. We will be staying at his home when we first return (which I've used as my permanent US address for many years). Since we will be staying in his home, should he fill out the I-864A or does he need to do the I-864? Thanks!

Met in Canada, both moved to South Korea to be teachers! ❤️

So you had your interview and the officers said that what you did was correct? Sounds great, thanks :)

We were in the same position as you and had my dad fill out the I864. We had no problems at the interview.

Hi Penguin, I appreciate you are a visajourney veteran and thank you for taking time to moderate and be very helpful on the forum. However, I would like to ask where you got the above statement from because if your statement is true, my papers may not be in order.

I am the beneficiary. My USC husband filed an I-864, and his step-father who lives in the same address as my USC husband filed an I-864a as a co-sponsor.

The instructions for who can file an I-864a simply states:

"For the purposes of the I-864a, a household member is:

A relative who has the same principal residence as the

sponsor and is related to the sponsor as a spouse, adult

child, parent, or sibling;"

If parent and petitioner are living at the same principal residence, I cannot find anywhere on the instructions the requirement to prove financial dependency between the sponsor (petitioner) and the co-sponsor (parent). All that is needed is to prove the relationship between sponsor and co-sponsor (birth certificates etc).

Interview date: May 2, 2013
POE: May 2013

See the posts below, just because it was correct in one poster's situation doesn't mean it is correct in yours.

If you read past stories here, you will see many, many people who only submitted a I-864A for the co-sponsor and got delayed because the embassy wanted a I-864.

If you are unsure, like I was, I had my dad fill out and sign both I-864, and I-864A just to be sure. It's almost basically the same form.

Also, At the embassy, they asked why I didn't file any taxes the past few years (I'm a student), they made me write a statement explaining why on a blank sheet of paper.

Well if I can't prove that I will have immediate employment in the US when we return, we would be considered financially dependent, right?

Either way, I guess I can prepare both documents and submit the one that they request at the consulate. Thanks for all the info.
