Ok guys. It's time to get into the game.

It's been 8 months since we submitted our paperwork for AOS. Still no news from NBC. I got my EAD and AP but no greencard yet. And the reason I am posting this is I can't see any light at the end of the tunnel.

Couple weeks ago, I called USCIS they transferred me someone to talk to. (This guy is supposed to be a higher ranked officer or something I am not so sure) After being on hold for 45 minutes I finally hung up the phone without being able to talk to anyone.

Any ideas or suggestions on what I should do?

I remember applying for 129F October 2011. It's been a loooong time. Still struggling thru the paperwork :(

We are a month behind you and I have not seen any approvals recently come out of NBC. I really don't think they are even working on them. It seems everyone from August (when they stopped transferring to cali) is still waiting. It's ridiculous. Have you tried to contact your congressman? That will be my next step in a few weeks.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Going on 9 months with no progression. I have no idea if my case is in my local office (philly) or still at the service center.

Called the USCIS. Dont waste your time calling I stayed on the phone for 1 hour to speak with them got the teir two person they opened a service request that was all. The outcome of the service request was " if you dont not have a decision or hear from us in 6 months you can call again"

Got the Congress involved. All they can really do is check on the status of your case and why it is delayed. That response was "We have reviewed the above referenced file and found that the processing is progressing at a normal pace. The A-file and Form I-485 are in good standing. I regret that I cannot give you an estimate of when you can expect to get notice that the file is moving forward. "

Nothing really you can do. There really is nothing. DOnt even try the info pass that will not help in any manner.

It would at least be nice to know where the case currently is being process or currently sitting.

According to the USCIS Dashboard, my local office, Hialeah, FL, got swamped, they are at 6,043 pending applications for the I-485 and are processing at the July 28, 2012.

I-485 Approvals for Hialeah: AUG12 (516) , SEP12 (581), OCT12 (334), NOV12 (267), DEC12 (226), JAN13 (290), so looks like less than 300 approvals per month.

NBC Processing Times is a bit of a misnomer in some cases, as NBC does not determine processing times for I-485 and

N-400 applications, which constitute the majority of the NBC’s workload. NBC does not determine processing times

for those case types because NBC does not conduct final adjudication of those cases–a USCIS Local Field Office

does. So each Local USCIS Field Office determines processing times for Form I-485 and Form N-400 applications. For

NBC Workload and Procedure

The NBC’s largest workload is Form I-485, Application to Register Permanent Residence or Adjust Status (the final

step in the Green Card process for those who are not filing for Immigrant Visa Processing at a US Consulate

overseas), and the Form N-400 Application for Naturalization. These two applications are estimated to reach well

over a million cases in FY-2012.

In the Form I-485 process, an applicant must provide all initial evidence before s/he can be scheduled for

interview at a local USCIS Field Office. If evidence is missing, the NBC will issue a Request for Evidence (RFE).

An RFE places a hold on the I-485 application, as well as the associated applications filed with it (for example,

Form I-130, Form I-765, Form I-131) until NBC receives the missing initial evidence.

Missing evidence will not delay N-400 processing at the NBC. But if the missing evidence is not provided at the

time of the N-400 naturalization interview in the local USCIS Field Office, the adjudication of the N-400 may be

delayed, or the N-400 may be denied.

Contacting NBC

If you need to contact NBC regarding your case, please call the National Customer Service Center (NCSC) at 1-800-

375-5283. The representative taking your call will send an electronic message to NBC that will be answered within

15 days. Expedite requests, for certain applications, are answered within 5 days.

So how do you know after 9 months and only an acceptance NOA if your application is sitting at the NBC or the Local Field Office?

For what I have read, the no-interview applications sit at NBC until the field office gets around to it to complete the job or do the final adjudication. If you have not received an RFE, which happens shortly, such as within a month after submitting the package or have been designated for an interview, your best bet is that your stuff is at a nice dusty cabinet at NBC. Calling ain't going to make a difference, because everyone is being told the same thing, "Wait". There are folks here at VisaJourney who are at the 11 month waiting. As things go here in the Miami area, less than 300 approvals a month and over 6,000 applications, it's going to take longer than as it was. When I check Miami and Hialeah local office processing, they are both at the same date 28 July 2012.

So how do you know when your case is transfered to the local field office? My local field office says processing I-485 within 4 months. So I assume the case is still at NBC and not at me local field office.

My application is in my local office (TPA) all the time, I got my EAD/AP and NO RFE.. At this time I am not even scheduled for a interview.. The only answer is WAIT, or ''call back in a month''

I live it up to you to conclude what that means :)

So does anyone know if anyone who has an NOA AFTER August 1, 2012, AND has not been called to their local field office for an interview, been approved? It almost seems like USCIS is just sitting on these cases because they have more important things to do....like making sure illegals get a pass to legally reside here!!!

Thank you for all your answers folks. I am really frustrated with this. I came here on a K1 visa which means we got approved for I129F in the first place... Why more investigation? They knew I was coming here to get married.

I can't apply for jobs I want to apply for. Yes I have EAD but I got turned down from two companies because they couldn't hire anyone with an EAD. Is that illegal what they did I don't know and I do not care. I blame USCIS for this. It's been 8 months. I didn't get a RFE, my case status didn't even move to initial review. I just don't understand what's going on... All I know is that it is not fair that we have to wait this long.

Hey, yesterday USCIS updated web side, maybe some good news for you :)) Not for me .. Acc to UPD they are processing 28 SEP. while my application is from 24th and still no any info, no any letter- nothing .. Shall I wait and see what will happen next 2 weeks ?? or call them today ??

My husband has run into the same problem with EAD. He got turned down for employment because they wanted green card instead of EAD. (was told EAD was temporary and to come back when he had a green card)

It is ridiculous that it is taking so long to process these. We have been thru all the background checks and interview with the initial K1.
