postponing/cancelling visa process - visit possible on VWP?? German citizen

Hi,

my husband and I are both students and it seems like we will not be able to go through with the visa process because we cannot show the financial support (even though practically we would have enough). It really sucks because we have already paid some part of it and have to make a whole new plan...but it will be ok as long as we can be together at the end.

Now we decided for him to move to Germany because the rules here are less strict. I will be done in June with my college and start my MA degree in September. Since my husband still has school until August, I would like to visit him during the Summer and we would fly back to Germany together (immigrate) mid/end of August.

I was wondering if you know of any case where they postponed/cancelled the visa process and had no problems going to the U.S. on a tourist visa. Since I am German, I don't need a visa, but I was wondering if I might still get denied because I had the visa application prior and that they might think I would want to stay there..even though it won't be possible anyway because we don't have the official income requirements that they are asking for.

Any experience would be greatly appreciated!

The difficult thing would be convincing the POE officer that you will return to your country at the end of your visit. Since you have an American husband, it's going to be hard to prove to them that you will absolutely 100% be returning to Europe, and won't just stay in the States and adjust status. If you can't prove beyond a shadow of a doubt that you plan on going back, they could deny you entry and send you straight back to Germany.

Do not cancel the visa process. It will be cancelled automatically if you don't submit the required documents to NVC in one year. Until then it will be considered to be in process, so the officer at the POE will not know you changed your mind. Prepare proof that you will be returning to Germany (letter from college about MA degree, bank accounts, lease, etc). You should be fine, VWP countries don't usually have difficulty visiting during the process.

Thanks so far!

I also heard of people postponing it, but I am not sure for how long we might stay in Germany..it might be for a veryyy long time since my husband would like to go to medical school in Germany...

I am just wondering if we cancel it so that it will be easier for us to visit the US during breaks etc...but if we eventually would like to return, I am worried that it might look bad if we have it cancelled!

A little bit confusing so far..

Also, unfortunately, I will not be having a lease during the summer time..since I am studying in the netherlands (and finish in June), I would like to cancel my lease (to save the rent money) also because I am not interested in living in the Netherlandas anymore, I would like to go back to Germany.

I would only be able to have bank accounts in germany and the possible enrollment from the university...even though it is very simple..I am worried that it doesn't look too strong?!

the problem is we thought someone would be able to sponsor us, didn't work =(....but it is complicated and we don't really have any relatives who would be eligible and since we are still very young, we don't really know anyone that well who would be ELIGIBLE and WILLING to do it.

i understand that it worries people that they would be legally responsible to take care of me. it is very very stessful and there is nothing we can do :'(

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Why continue with sponsoring now if plans are for both of you to live in Germany while he goes to med. school

if approved and you get GC now you have to live in the US, if gone over a yr you lose it, but if you really want

to continue petition a friend or family in the US can co-sponsor
