August 2012 AOSfor K1 VISA Filers/Green Card Status

Hello Everyone. Just trying to reach out to the August 2012 AOS filers who brought their fiancée here on a K1 VISA, got married and then filed the AOS. Our priority date for the I-797 on AOS was August 27, 2012. When I contact the NBC, they related the case was submitted to Lee's Summit, MO. They related it would be transferred to the local field office in Indianapolis for processing. I checked a couple of weeks ago and they finally are at September 2, 2012. I called NBC again and went to tier 2 and they sent an inquiry to the field office. Same mumbo jumbo about give it 30 days to come in the mail. The officer also told me that all marriage based AOS would be interviewed. I know for a fact this is wrong, because my previous K1 VISA AOS had her GC in 3 months without and interview. I finally have a great wife and we are going to have our baby around September 4, 2013. USCIS is starting to frustrate me. I front loaded the AOS with plenty of supporting evidence. Has anyone received their GC and how long did it take. Did you have to go through an interview also at your local field office. Thanks in advance.

I certainly understand your frustration. We filed for my husband's AOS in August 2012 also. According the the USCIS website (as of today), it still says that the status of his application is in the "acceptance" phase. Our case was also sent to Missouri. I have not called anyone yet, because I have read other posts that say it could take as long as 9 months. I do, however, feel a bit concerned that it appears to still be in the beginning phase. But then again, I think that this is unlikely, since it took no time to get his appointment for his biometrics, and then he received his EAP/AP card in October....so perhaps the website has not been updated when our case has been viewed/processed.... I don't know. I'll give it one more month and then, I will start making calls.

Timeline

Filed AOS for K1 and K2 based on December of 2012, received green card last month. So around 3 months if you remove all the holidays at the end and beginning of the year.

I understand it's frustrating but be patient, atleast you are now waiting with your wife next to you :yes:

I applied in July 2012, got my EAD/AP card in September and received my GC in February. Mine was sent to NBC and we did not have to interview.It did not go to the field office but sat at NBC the whole time. I know that some people who filed their AOS in July are still waiting for their approval.

As it's taking a long time, it's most likely an indicator that you're not going to be scheduled for an interview. In that case, your case will not be forwarded to your local USCIS office, but will stay and be adjudicated at NBC. Looking at the processing time of your field office is then irrelevant.

As I said, it is more likely that your case is not at your local office, otherwise you would have been scheduled for an interview already. Your case will more likely stay at NBC (at Lee Summit, MO) and be adjudicated there without an interview.

Not all marriage based AOS cases are scheduled for an interview (K-1 are the exception). About half of the AOS from K-1 are adjudicated without an interview (and so, never go to a local USCIS office).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Some discussion has been put forward regarding if NBC adjudicates according to your local office dates, even if you have an interview-waived case. I have never been able to suss out if this is accurate. I do know that our case is at 7 months and according to USCIS as of yesterday it is at the local office. I don't expect we will have an interview at this point but I could be wrong.

I'm going to call back today and see if I can get more information (i.e. Tier 2 officer).

As I said, it is more likely that your case is not at your local office, otherwise you would have been scheduled for an interview already. Your case will more likely stay at NBC (at Lee Summit, MO) and be adjudicated there without an interview.

Then my question would be why did tier 2 at the NBC say it was at the local Indianapolis office? Tier 2 should be able to tell you exactly where it is. I kind of agree if the local office is on October 11, 2013, then why have I not receive a notice for an interview. I will have to wait patiently, but I cannot believe how in efficient the USCIS is with their processing of AOS.

Just an update on my AOS situation filed for my wife. After getting the run around from the NBC, called them on March 22, 2013 and never received anything within 30 days, I scheduled an appointment with USCIS at the local field office in Indianapolis. At the same time I sent requests to my SEantor and COngressman for help in our matter with USCIS. On Monday, April 29, 2013, we went to the local USCIS field office. We talked to the officer and she looked into my wife's AOS. She did not see an inquiry from the officer from the NBC March 22nd. I told her the officer infoirmed us back in March, that our AOS was at the local feild office. She related it was not at the local field office. She checked a couple of places in her system and found the AOS was still in the mail room at Lee Summit, MO. She sent an expedite inquiry on our behalf and gave us the reference number for it. Her inquiry is suppose to be addressed by May 4th. I had also sent an inquiry online and she found it in the system also under the the status "Processing outside of time guidelines", It is supposed to be answered by May 7th. I did the online inquiry on Aril 22nd, but it didn't let you put in a lot of information. So now I have to wait on USCIS again at the NBC in Lee Summit, MO. Starting to get a little pissed off as I front load the AOS with more than enough information and supporting documentation to support our marriage as legitmate. The office at the local field officer didn;t know if it had be looked at yet or if it was back in the mail office for further processing. Still a waiting game. Will see what comes out of the inquiries and the e-mail sent to the Senaotr and Congressman. If anyone else that has filed in August 2012 is having the same problem or have recieved thier GC already, then please let me know. Thanks.

My NOA1 for AOS is 1 week after yours ( sept7) and we have not heard a thing. I filed a service request in March and never got a response. I filed a second service request yesterday. I have only seen 2 or 3 posts from August AOSer's who are at NBC post that they have been approved. There have been a few from July recently approved. I think the majority from August are still waiting. KEEP us posted - I hope you hear something soon!

Okay just another update to my wife's AOS that we filed in August 2012 with a priority date of August 27, 2012. After getting a BS letter from USCIS on May 6th about what date my wife had her biometrics in September 2012 and to look on the USCIS website or call the NBC for further information, I called my congressman's office directly in Indianapolis. I talked to his representative and she e-mailed me a privacy release form and I documented the steps I had taken and the run around I got from the NBC. I also gave her the I-797C for the acceptance of the I-485 with the priority date, etc.... Within 30 minutes, she called me back and informed me she had talked with an officer at the NBC and was told that it takes 6 to 9 months before the petition would be completely adjudicated. That my wife's AOS is still indeed at Lee Summit, MO NBC, not the local field office as the NBC tier 2 told me and the NBC is currently working on Priority dates of August 2, 2012. The only positive I could take from her calling me back was that she was informed that our case was in the Interview Waiver Status, which means we won't have to have an interview. She told me to mark my calendar for June 7th and then call her back with an update or earlier if we have received the green card or anything else from USCIS. If they haven't acted by then she would call their office a second time and try to turn the heat up a little. She did ask if our case could be expedited or looked at earlier and they told her that unless it was a medical emergency or for financial reasons, they could not. I still think that since the congressman's office called USCIS, they will act a little faster on it. If the average is 6 to 9 months, then our 9 months is up on May 27, 2013. Well a little news is better than no news. At least now we know the actual status of our case. Calling the NBC either tier 1 or tier 2 is a waste of time, but is a necessary evill and will most likely need to be done to let your congressman know what steps you took to try and get an answers or a resolution before contacting them. Now we will wait again. If USCIS is so understaffed, HIRE MORE OFFICERS!!!!!!!!
