AOS for K1 Visa Holder, final questions

I am USC. We are filing the AOS for my wife. She came to US on K-1 Visa in Nov 2011. We are just getting around to finally sending in AOS paperwork.

A few final questions before sending it off.

1) On the I-485, Sec A it asks for "Non-immigrant Visa Number." Where can this be found? Is this a number on the "Visa" that was put in her Colombian passport when they gave it back to her when she was approved for the K-1. Or is it a number that is on the white page that US Dept of Homeland Security stapled into her passport at the airport.

I assume it's a number on the "Visa" that was put in her passport when she was approved for the K-1 Visa. The problem is there are so many numbers... a) Control number .... b)An A200... number they handwrote on it, or c) All those numbers across the bottom of the Visa?

2) On the I-485, Sec A... date Visa issued? This is the "Issue Date" listed on the Visa that they put her passport, correct?

3) On the I-131, skip parts 4-6, correct?

4) On the I-131, 1 trip or more than 1 trip? If we put more than 1 trip does it make it less likely it will be offered? As far as explanation on a separate sheet of paper is concerned, is this necessary? Does there need to be a good reason for them to authorize the Advance Parole? I.e. We really just want to go travel around Brazil and Argentina for a few months this summer. She'd also like to go back to Colombia to visit her mother for a week or two after our summer trip. Are these reasons going to get denied? Should I just "Not send in an explanation on another sheet of paper?" or should I just list One trip and put the summer vacation or just list one trip and put the visit back to Colombia to visit mother?

5) G-325A, is this on her or on me? Or both?

6) I'm sending in I-485, I-864, G-325A, I-765, I-131, G-1145, I-693 (we had one done in US since it's been over a year)... any other forms needed?

7) I'm sending it all at once, so am I correct in thinking that I do not need to pay for the I-131 or I-765? One money order total, correct?

8) How many photos in total for all of this?

9) One package sent by USPS via CMRRR, delivery confirmation, correct? Which dropbox do I send to? I am USC living in Texas, she is from Colombia.

If you know these answers, please answer as I am trying to get it all done within the next 2-3 hours before I get on a plane.

Did you get married in the 90 days following POE?

It sounds like she has accumulated >180 days of illegal presence in the US. If she travels out of the country during AOS she might get a ban from the US, even if she has AP.

As far as explanation on a separate sheet of paper is concerned, is this necessary? Likely not. Does there need to be a good reason for them to authorize the Advance Parole? I.e. We really just want to go travel around Brazil and Argentina for a few months this summer. She'd also like to go back to Colombia to visit her mother for a week or two after our summer trip. Are these reasons going to get denied? Should I just "Not send in an explanation on another sheet of paper?" or should I just list One trip and put the summer vacation or just list one trip and put the visit back to Colombia to visit mother? Don't over think this. We put two weeks to see her mother.

5) G-325A, is this on her or on me? Or both? It is her application for Adjustment of Status.

6) I'm sending in I-485, I-864, G-325A, I-765, I-131, G-1145, I-693 (we had one done in US since it's been over a year)... any other forms needed? Seems correct, consider re-reading and confirming with the AOS Guides.

7) I'm sending it all at once, so am I correct in thinking that I do not need to pay for the I-131 or I-765? If sent concurrently with the I-485. One money order total, correct? Yes, for $1070

8) How many photos in total for all of this? Six

9) One package sent by USPS via CMRRR, delivery confirmation, correct? Which dropbox do I send to? I am USC living in Texas, she is from Colombia. Send to the Chicago lockbox, as per instructions. Consider double-checking with the instructions.

If you know these answers, please answer as I am trying to get it all done within the next 2-3 hours before I get on a plane.

Which year did you get married? If it was 2011, it may have a bearing on her eligibility and applicability of AP. Check I-131 instructions for specifics. If it was 2012, shouldn't be an issue. As other posting mentioned, :time: It helps everyone that uses the forum.

Wow, yes I hear you regarding the AP. So did you think she will not be given AP? Will we need to wait until she gets her Perm Residency before she is able to travel outside of the US. I recognize that if they give her the AP, if she were to use it I guess there could be a ban since we waited so long to apply for her Perm Residency as they will look at it as though she overstayed by more than 180 days, correct?

So should I pretty much forget about the summer vacation, or is it possible for her to travel after getting the AP?

It sounds like she has accumulated >180 days of illegal presence in the US. If she travels out of the country during AOS she might get a ban from the US, even if she has AP.

The red number stamped on her visa? I'm glad I asked. That is the last number of all the different numbers on her Visa that I would assume it is.

I will update our timeline this weekend, when I return. Need to catch a flight.

Which year did you get married? If it was 2011, it may have a bearing on her eligibility and applicability of AP. Check I-131 instructions for specifics. If it was 2012, shouldn't be an issue. As other posting mentioned, :time: It helps everyone that uses the forum.

She will be granted the AP anyways, but it would be very risky to use it. Best would be to wait for her green card if she wants to travel out of the US.

- Aug 31st, 2011 - Mailed I-129F package - May 29th, 2012 - Mailed AOS/EAD/AP package

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received

ROC Timeline

- May 19th, 2014 - Mailed ROC package to CSC

- Aug 8th, 2014 - Green Card received

N-400 Timeline

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.

- Now waiting...

She will be granted the AP anyways, but it would be very risky to use it. Best would be to wait for her green card if she wants to travel out of the US.

Good point. :thumbs: There have been reports of issues with folks using their AP cards.

My wife received, but never used her EAD/AP combo card. We decided it best to wait until she got her GC. Incidentally, she used her GC one month later for her month-long trip to China to tie up loose business ends. She had no issues using her GC.

Yes, issue date on visa.

Yes, you are applying for AP, so skip to Part 7.

Check more than one trip and put Unknown for travel date and length. No explanation sheet is required.

AOS is for the foreign spouse. Only they need one.

6) I'm sending in I-485, I-864, G-325A, I-765, I-131, G-1145, I-693 (we had one done in US since it's been over a year)... any other forms needed?

No. Those forms plus the supporting documentation for them is all that needed.

7) I'm sending it all at once, so am I correct in thinking that I do not need to pay for the I-131 or I-765? One money order total, correct?

No fees for the I-131 and I-765 when filed with a pending I-485.

8) How many photos in total for all of this?

Six. Two for each application.

The one listed in the I-485 instructions. They all go to the Chicago lockbox. Makes no difference where you live or what country she is from.

If you know these answers, please answer as I am trying to get it all done within the next 2-3 hours before I get on a plane.

I do not think I answered before you had to catch a plane, but wanted to answer anyway, as it could help someone else that might have these same questions.

Also, they will grant the AP no matter if you should travel with it or not. Since she has been out of status for so long(more than 180 days), I would not suggest taking the risk of traveling with AP. I would wait for the green card.
