Hello, I am in the final steps of preparing to file for my husband for a CR-1 Visa. I was on the UCIS website and saw this tidbit:

To be eligible for a K-3 nonimmigrant visa, an individual must:

Be married to a U.S. citizen

Have a pending Form I-130, Petition for Alien Relative, filed by the U.S. citizen spouse on his or her behalf

This means that once I file for the I-130 , I can file for a k-3 for my husband so he could work here while the immigration process was going through? Just want to make sure I didn't miss anything.

Whilst you can certainly apply for a K-3, it's highly unlikely you will receive it.

Nope he cant work in the USA and he cant come live in the USA if you file for a K-3. The K-3 is no longer issued, and if you attempt to file for it its going to slow down your CR-1 process even more than it usually would take.

The K-3 used to be a different visa that was quicker a very very long time ago when the CR-1 was very slow. Not the case anymore.

The K3 rarely makes it through anymore. It was introduced, from my understanding, so that family members could come to the U.S. while waiting for their CR-1 to be processed HOWEVER, the CR-1 doesn't take as long as it used to so this process has become obsolete for the most part. In addition to this, I don't believe you can work while on a K-3 but have to apply for work authorization, I have no idea how long that component would take.

If he were to get the K3 visa I believe he cannot work on a nonimmigrant visa until you file more papers, pay more money and wait

He will work quick on a CR1 immigrant visa

I sure wish USCIS would redo their website about K-3 visas.

USCIS doesn't issue visas, so bear that in mind, aye?

So basically that information is outdated?

...Why don't they update their site then? And to clarify I am filing for a CR-1 Visa, but was just reading the website and it said that I COULD file for a k-3 in the meantime, while the CR-1 processes.

Technically the K-3 program is 'still open' because Congress hasn't passed legislation against it (the legislation that put it into effect).

So, yes, USCIS still accepts the I-129F when one wants to chase after a K-3. Sorry.
