Filed in December 2012, why is it taking so long?

Hi everyone,

My wife filed the I751 in December, received the green card extension in January.

Did the first biometrics on Jan 24. Fingerprints were rejected so she redid them on Feb 5th. And since then, we haven't heard of anything. I saw that the last "touch" was in December when the application was received.

We called the 1-800 support but they just give us the same status then what's online.

Why is this taking so long? It's been 3 months (we were done with AOS in that time frame already).

I am the US citizen, my wife is the applicant.

Adjusting from J1 Trainee visa:

August 25th, 2010: Filed AOS package to USCIS

August 27th, 2010: Package received by USCIS

September 2nd, 2010: Received I797 for I-130, I-485, I-765

October 14th, 2010: Received biometrics appointment letter (will be on Nov 5th)

AOS interview will be on January 13th, 2011!

January 13th, 2011: Approved at the day of the interview

Next step, removal of conditions

Just be patient. Many of us are expecting and seeing over 9 months processing time. The guide line's 6 months figure is now obsolete.

Since CSC is no longer (maybe) processing i751, it all falls back to VSC and other agencies to process them.

It might be a result of the government cutting back on budgets, thanks to the politicians, and/or many other factors.

Wait for them to start getting things done. By the mean time when the 9 months mark approaches and still nothing, get hold of them and ask for a service request. If in a month or two still nothing, start your N-400 Naturalization (if that's your goal) process, that'll force them to make a decision on your I751, while the same time make an InfoPass appointment to stamp a i551 stamp on your passport to extend your current status for another year.

Lastly, the optional thing to do is get your congressman involved. But that's good if it's going beyond 9-10 months.

Just FYI I had to do the said above, now I'm a naturalized citizen with a pending i751.

Go figure.

We filed my husband's ROC at the end of January 2012, and he got his 10 year green card in early July 2012, so it took about 5 and a half months. And that was when CSC was processing the paperwork at a faster rate than VSC. Patience is the name of the game. Good luck. :)

OP: this has not been confirmed. It's just a speculation going around in the forum in the past week or two, because the California Service Center is not listed in the latest USCIS processing date reports for form I-751. However we new ROC filers have not been instructed to send our documents anywhere else, there have been no new I-751 instructions or announcements on the website, so we all continue to send our documents to CSC.

If you ask me, I think they just ommitted to list CSC for I-751 processing by mistake and they haven't corrected the mistake yet. To be honest, I have been relying more on VJ members' timelines and updates than official USCIS updates, because the latter will always take longer to update in their system, whereas VJ members will always report any changes in their application status as soon as they are aware of them :yes: .

That being said, with current standards, you'd be lucky to be processed at 6 months. Some people do get processed in 6 months, but for most it's more like 7-8 months right now, for some even longer than that. So 3 months is still way too early. The reasons for the delay: pretty much what Steve D. said above and nobody can say with certainty. Try to be patient and get on with your life as normal until you hear back (but don't expect to hear before June at the earliest and I'd advise you not to expect anything before July-August, to avoid disappointment).

Hi guys!

I also filed for ROC in December 2012 and had my fingerprints taken in the beginning of February 2012 and still nothing.. At the time of fingerprinting the officer told me that I should now be expecting my 10 yr card in mail.. I didn't realize it actually takes so long (6-9 mnths) to receive it! I have a question though, when I mailed the paperwork in (in December) they send me a letter of extending my status for a year and then only an invitation for fingerprints.. so all i have is that letter and my expired 2 yr green card .. so my question is, I would like to plan a trip overseas, do i have to wait to receive my 10 yr card in mail or is that letter sufficient enough to be able to return to the US? Thanks so much everyone!! :)

No, you can work and travel as normal with the extension letter, you do not need to wait for the permanent green card. When traveling overseas, be sure to carry BOTH of the following with you:

1) your original green card (doesn't matter that it is expired) AND

2) the original extension letter (no copies, they only accept the original, and people have gotten in trouble before for trying to travel with a copy of the letter)

With those two documents, you should be good to go :)
