Well i do take advice from many.. Im a social worker and can guarantee u i have no chip on my shoulder. I actually believe the nigeriaor bust person displays that type of attitude therefore i responded in thus manner... I greatly appreciate this venue of communication with others goin thru the same process. As for advice, i paid an attorney for that, a visa specalist and aside from long waiting times i dont suspect any issues. My attorney as well as the USCIS both told me today that a 2 week waiting time between divorce judgments and filing is not accurate wen i called them in a panic after reading her post.. USCIS was the first i got a hold of.. Then my attorney returned my call n both confirmed the innaccuracy of her statement.. The other bad advice (opinion) she gave me the first day, another patron on this site corrected her when she rudely blurted out that Nigeria has an automatic OP after the interview.. (Also made me freak out) and was also confirmed to b poor advice and not true thru my attorney.. I just feel if u give sumbody advice.. Plz try and go on experience or factual basis... Dont just start talking to discourage ppl! Thats disrespectful in its purest form and rather ignorant.. But for all those on here kind and caring and supportive, i believe God blesses them for assisting others and for their comfort.. Overly opininated ppl that do carry a "chip" r destructive and not of any real help.. Sorry if i over did it on my response.. Im just here for the same reason anybody else is

1 - plenty of stories on the site about attorneys. some good, some bad. having an attorney doesn't impress people. know the process and the paperwork so you can double check on your attorney. there are far too many stories on this site about the attorney did X wrong or forgot Y form and so on.

2. reading comprehension helps greatly on the site too. nigeria never said there was a two week waiting period for you - she gave an example, specifically california.

3. as for the automatic ap (not op), i've not tracked that region so i can't weigh in on whether that's accurate or not, but i'd hedge my bets by betting on nigeria's advice. if you don't get ap out of it, count yourself as one of the very fortunate few.

4. this isn't a rainbow and unicorns site. members, particularly the ones that have been around for a while, have seen the good, the bad, and the ugly when it comes to petitions and situations. the advice offered by these members is based on their firsthand knowledge and their reading - and best of all, it's peer reviewed in open forum. if someone is offering you advice via pm, know that said method is discouraged for the very reason of it's not peer reviewed - insist on advice in open forum.

1. She specified California as an example and suggested you double check the rules for YOUR state to make sure

2. Actually I think that was me. Here's the post and the person who corrected ME: http://www.visajourney.com/forums/topic/422147-contacted-mr-neufeld-director-of-csc/page__view__findpost__p__6102517 Nigeria is high-fraud so it's usually harder and most people I've seen go into AP were from MENA countries, I don't actually track them so that's my fault.

If you freak out then perhaps you shouldn't be reading the forums. There are a lot of bad stories, especially out of Nigeria. Of course it's totally up to you but this is a DIY site and if you're going to run to your attorney to double-check then it kind of negates the purpose of asking here... but again, nothing stopping you from doing it. That said, you stated here: http://www.visajourney.com/forums/topic/422147-contacted-mr-neufeld-director-of-csc/page__view__findpost__p__6102468 that your attorney told you 2-4 months total processing time, which is a total lie, I personally wouldn't be trusting an attorney that tells me that.

I wish you and your FIANCE the best of luck but like everyone else, I suggest you tone back your attitude.

when you 'sent in divorce decree same day' - what does that mean, exactly ?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

@ Darnell.. I meant that when i sent all of my paperwork to our attorney it was the same day my divorce decree was signed and dated by the judge due to the filing fee never being paid per court order by my x-husband... So the date on my divorce is litterally just a few days before my filing with the CSC uscis.. I dont know why that would be a red flag and its possible it would be. However filing requirements do not prohibit it and our attorney says it would not affect our visa and thats wat USCIS say as well..

ah. got it. expect a question about it at the interview in Lagos, unless a letter of attestation was submitted with the I-129F covering the divorce date and I-129F filing date.

MANY people round the world follow the rules, filing an I-129F when they are legally free to marry - no worries there - but it's Lagos, and the Vice-Consuls there like to sniff out problems and cause more problems.

There was no false information, you simply misread it. It's a shame really but things happen for a reason.

People respond to you in the manner in which you posted. Your posts were antagonistic, hers were not. You are calling your fiance your husband and you're filing at one of the highest fraud embassies. To say it's foolish doesn't begin to cover it.

It is good your profile is being deleted, at the very least I would also ensure any posts referring to your fiance as your husband are also removed because embassies HAVE been known to check social media sites, and members have reported being addressed by the VJ name. If they suspect (they need NO proof) that you are married you will be denied and you will need to marry and file a CR-1. Even then the CR-1 does not guarantee approval. You may also require proof of several visits and may need to attend the interview. You should read embassy specific information to know for sure.

Thank you.. Fake names, fake picture, not real sure how anyone can determine our visa on any of this considering they cant link it to our real identities.. Which from being in law enforcement for years before entering human services i learned to do. I never ever reveal my true identity on a public forum.. However it is and was great advice to not use the term husband or wife due to the scrutiny possible at the interview and i will use that advice from here on out. Thank u again for ur advice

Nothing you post online is hidden by fake names or profiles. Your computer is using an IP address(es) given to you by an internet provider the mods can probably see it and the government definately can. Never assume that you can't be tracked. ANY email to someone outside the US , especially to any country that have committed terrorist acts against they US may be monitored. Nigeria entered that list of countries in December of 2009. I did warn someone about AP and they were a MENA poster, and anyone can tell you that AP there is mandatory and frequently years in length although some may complete it during the process. AP in Nigeria used to be unheard of and after Dec 2009 it spiked and now has become less frequent. You have at least 2 red flags and are trying to push a K1 through Lagos. You will likely be interview closer to the end of the year unless things break lose in the approval department. I have been on this board longer than most and kept track of what happens though Lagos. To attempt a K1 filed right after your divorce doesn't bode well. The K1 approval rate for non Nigerians petitioning Nigerians is terrible.

Ah but we can't possibly know more than her attorney!! I mean, 2-4 months for approval (which has apparently been changed), no AP, referring to her fiance as her husband, posting the USCIS can kiss her "white a**" if they don't like it... yeah. I see GREAT things in her future and it's awesome she has such a fabulous and knowledgeable attorney to guide her through the process...

But seriously, thank you for coming back and posting. I honestly believed AP was mandatory in Nigeria, probably because I've been here since 2009 and that's when you said it was really common. Someone posted following me in the thread I linked above and told the OP that "many K1's are approved out of Nigeria". Talking like it was a low fraud country... I about fell over with shock because that's not how I read most of the Nigeria/Lagos posts...

What is even more shocking is the "untold" story. You will notice that a lot of couples are posting loudly about their impending interview and then nothing. It isn't because they got the visa. Between that and the fraud rate ( USC's dumped by their Nigerian love as soon as green card/10 year card or USC is approved ) One has to wonder how fake this is and what CO wouldn't be able to match it to a intervieweephoto-156549.jpg

OP one thing I really want you to do to make sure for your sake your lawyer is good like you say. There are immigration attorneys and there are those who know Lagos. Please do this I hope you still around and report what they say.

First I have to ask what did you put as evidence in your filing of petition?

Ask your lawyer "Did we front-load the petition?"

I ask you to ask because I just went through this with someone who paid $3500 for a I-130 with no evidence just the required marriage certificate. Surprising they made it to interview but they were denied. Now awaiting case to come back. Her lawyer said evidence wasn't needed. And if USCIS wants it they will ask for it. You can show evidence at interview.

I can't tell you )especially for Lagos) how many couples have vital evidence in their arsenal all read in binders and folders at interview and the CO won't look refuses to take it. It could be to answer the question "why hasn't she come back since 2 years ago". And the person was just there but CO won't look at evidence. Yes front-loading.

So I pray you front-loaded that petition. All embassies/consulates are not run same or created equal. Lagos is in a category all its own. Approvals are getting way better but its only because of prep work and couples doing their due diligence. Evidence is one thing but how our love one presents, talks and answers at interview is vital.

God bless you and your man and wish you all the best.
