Also....anybody know if it matters if you get your NOA1 before the expiration date of the visa or do they base it on when your package was postmarked?? My wife's CR-1 visa expires on April 22nd, and it looks as if they won't cash my check or send us the NOA1 until after her expiration date.

I believe they base it on when your package was postmarked, so you should be fine on that front (i.e. it won't be considered to be past the deadline). However, without a NOA1 extension letter, your wife will have no proof of status come the 23rd, so I recommend you call TOMORROW for an InfoPass appointment and make one at your local USCIS office for Monday morning, so that she can get her passport stamped before her green card officially expires.

Just on some side note,

Do anybody know how likely you would have to go to an interveiw for this matter?

The lawyer I worked with for my GC two years ago, told me every person he knew who filed I 751 had to go to an interview.

So the chances are like 99%, he said. My husband has really tight work schedule and I just want to plan ahead little bit..

And I still haven't heard anything from CSC yet and even my check is still not cashed out. (CSC recieved the packet on 4/8)

This process makes me so nervous..

It seems I can't get any INFOPass appointments or maybe I am not selecting the right option...does it really matter if we aren't planning on traveling or anything? We have never been asked for her green card except for employment reasons...I am wondering if I am just stressin over nothing. I should be getting my NOA1 soon so it couldn't be a big deal if her green card is expired before we receive a receipt/NOA1 , right?

Your lawyer's information is not correct. I suspect he works mostly with cases that have red flags, and yes, cases with red flags ARE usually asked to go in for an interview, thus the percentage he gave.

The truth is that interviews at ROC stage are quite rare and are usually reserved either for cases with red flags or those with very weak supporting documentation. Sometimes they do conduct random interviews in what look like straightforward cases, but this isn't the norm. Most cases either get a straight approval or an approval after an RFE. On rare occasions, if the evidence submitted with the RFE is still deemed unsatisfactory, then an interview could be requested. Again, this is rare.

USCIS Officers adjudicating ROC are specifically instructed to avoid interviews if they can, since they don't want to pull too many resources away from other petitions where interviews are obligatory.

If you take a look at the threads from previous months' ROC filers, you will notice that interviews are not common at all and have mainly happened in cases where there was a divorce waiver, or a change of status mid-process, or similar.

You mean there weren't any available appointments through the system or that you couldn't find a link to make an InfoPass appointment?

I hope someone more knowledgeable can chime in here, but I believe that any Permanent Resident needs to have proof of their legal status at any time.

At this point, I would call the USCIS helpline, would explain their situation and ask what to do from here. I'm not sure if they can help you make an InfoPass appointment over the phone too, but you can always ask. At the very least, they should be able to tell you how to book one.

Did you read the post below? Looks like Infopass appointment is useless at this point. I would say give it 1 more week...

Well, we had our infopass appointment this morning. Hubby missed out on 3 hours of work just to find out that, while they CAN and WILL give him an extension stamp, it has to be closer to the expiry date. So pretty much, if we don't hear anything by the 24th, we have to make ANOTHER appointment for the 26th, and his GC expires on the 28th. It would have been pretty nice if the lady I talked to at the National Service Center would have told us that little tidbit of knowledge. Money is pretty tight as it is, and losing 3 hours for nothing doesn't tickle either of our fancies. We also found out that they haven't even put it in the computer yet... so it's just sitting on someone's desk at CSC while they take a coffee break, lol. :(

Blaaaah. You know... we didn't have any issues with K1 or AOS... I should have figured ROC would bunk it all up, lol...

Just called the National Service Center...the operator said that it really does not matter and that we should not go for an extension stamp because USCIS goes off of the postmarked date. He said that we won't have any issues because it was received within the 90 days timeframe. It does not matter if we have not received the I-797C/NOA1 yet.

Hello everyone!

I am new at this forum, but i would like to add my timeline too.

I mailed my ROC package on 8th, it was delivered on 10th, but i haven't gotten NOA1, nor my check has been cashed yet till today 19th. Of course i am getting worried since my green card expires on 28th this month. I called today to USCIS, but of course their answer was: "If you have filed less then 30 days, just keep waiting!"

I should probably make an appointment for info pass, although i read the earlier posts, and as it seems like it has to be right before the green card to expire!

If anyone has any other suggestions, i would love to hear them.

My wife is in a similar situation....her GC expires 4/22. The operator said that I should not make an infopass appointment because it is based upon the I-751 postmarked date when it comes to legality issues regarding expired GC. It may only be an issue if you plan on traveling abroad or something of that sort. You filed before the expiration date, that is what matters according to USCIS.

My wife is in a similar situation....her GC expires 4/22. Thank you for the support! Yes, that's what i am thinking too, but of course there is always this possibility you could have made some mistake filling out the papers and they are send back. I will just wait until next week and hope for the best! Good luck to you and your wife!
