What if someone doesnt file for citizenship during that 90 day window? Can they still apply later after the date on the greencard or once the 90 day window is over u cant apply? Would they have to wait until the 10 year greencard expires?

You will be eligible to file for citizenship (N-400) no earlier than 90 days before the 3 years anniversary of your residency (Green Card approval date, 7/13/2011 in your case).

That's right!

You cannot apply prior to the 90 days before 3 years anniversary of your residency (initial GC approval date) considering you are still married to US spouse. After that 90 days window is open, you can file any time until your green card expires in 10 years. But, if you get separated/divorce with your US spouse, you will have to wait for 90 days before the 5 years anniversary of your residency.

To answer your question specifically, once that 90 days window opens, you can apply anytime in 10 years. Or, you choose not to become US citizen you can apply to renew your residency 90 days before your 10 years green card expires.

That's right!

You cannot apply prior to the 90 days before 3 years anniversary of your residency (initial GC approval date) considering you are still married to US spouse. Is that 90 days from the conditional GC or the GC you get after the ROC?

If the condtional GC was received 2011, then theoretically in 2014 we can do the citizenship thing?

@rdbdds: DNIEPU is right with regards to citizenship eligibility.

Most of us filing ROC now in 2013 first became permanent residents in 2011. So in 2014 we will all be eligible to apply for citizenship.

To illustrate an example to make things clearer:

Let's say Person X first entered the country as a conditional permanent resident on May 28, 2011.
X needs to file ROC in the 90 days prior to their green card expiration date, so from February 27, 2013 and no later than May 27, 2013.

X will also be eligible to apply for citizenship any time from February 27, 2014 and on, as long as they are still married to their USC spouse and have maintained permanent US residence for a minimum of 6 months continuously for each of the 3 years since they first obtained permanent residence.

Let's also say that Person Y first entered the country as an unconditional permanent resident on May 28, 2011.

Y doesn't need to bother with ROC because they automatically got an unconditional 10 year green card (lucky them! wink.png ).

Y will also be eligible to apply for citizenship any time from February 27, 2014 onwards, provided that the above mentioned eligibility criteria are still met.

Are these months excluded from my 3 years and do I have to compensate by living 3 years and 5 months to apply or it doesn't matter and i still can apply as soon as 3 years end?

No, no need to compensate as long as you have lived in the US for a minimum of 6 months (continuously) for every year counted towards your citizenship. But obviously the more time you have spent living in the US the better, as they ask for specific dates you were outside of the country in the application, and being too close to the 6 month mark could trigger questions.

I had my biometrics appointment today! :) I had a long drive to Atlanta, but everything was taken care of as soon as I got there! My appointment was scheduled for 11 am, but I got there an hour early and I had no problem getting my bios taken :) I guess I have to wait 5 to 6 months now?? Crossing my fingers i won't get a RFE! Well I'm actually gonna keep my fingers crossed for all of us :P

July 25, 2013 - 10 year green card APPROVED!! (notification via text and email, and website updated)

July 29, 2013 - ROC approval letter received in the mail

July 31, 2013 - 10 year green card received in the mail!!!

My N-400 journey:

March 19, 2014 - N-400 package mailed to Phoenix, AZ Lockbox

March 24, 2014 - NOA1 date and Priority Date

March 27, 2014 - Check cleared

April 21, 2014 - Biometrics done

May 7, 2014 - In line for interview

June 23, 2014 - Scheduled for interview

Aug 27, 2014 - Oath ceremony, I am a US citizen!!!

Hey everyone, I went in today and got my biometrics done early. It was no problem, they let me right in. For a moment, they were'nt happy that I was using my drivers license instead of my residency card. However, the notice clearly said that either would be fine. It took them one minute to look at it and let me through. I was in and out in under 30 mins. They seem to welcome early comers as long as you get there early in the day.
