Hello,

while following the step-by-step instruction and trying to complete the form I864, I stuck at one point. I don't know how many of you have faced this!! In 'For Government use only' column of page 5 part 7, it says - "The total value of all assest, line 29, must equal 5 times the difference between the poverty guidelines and the sponsor's household income, line 24c".Does it mean if my assest say bank balance is not the 5 times the difference between the PG value and my current income then I CAN'T SHOW IT or IT IS USELESS TO SHOW IT!!???

Also, in case of showing my bank balance do I need any letter from bank or just the photocopy of account statement will work?? And at the time of interview does my wife need to submit any proof of ownership or CA report of her property and her assets??? OR May be I have to submit the proof of her property with this form if I used her assets to support the income!!? Correct me if I am wrong... SO THEN,.. IS IT THAT ALL SHE HAS TO DO IS GET HER MEDICAL REPORT back there in Nepal when case is forwarded to embassy???

Help me to get over this if anyone had worked with assets part while filling I864. Thank you.

You can show assets to make up the difference between your income and the 125% poverty level if you have income; the line you are quoting is for those who have no income, such as students or those who move from abroad back to the USA and thus have no current income.

I could show an original bankstatemenyts, as a photocopy would be too easy to fake.

If you are using property as an asset, you need a recent professionally done evaluation.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I am LPR and i don't have any current income. However I have income from last 3 previous years but they are also less than 125% of PG. So that means, my assets should be 5*125% PG value to meet the requirements.???

DemRa,

The way I read the instructions is a bit different. To be a valid sponsor, you must EITHER have income that is greater than 125% of the poverty guideline income for your household size OR you must make up the difference (Poverty Guideline income - Your income) with assets. The total value of your assets should be at least 5 times the difference. If not, you cannot sponsor your wife on your own. You will need a joint sponsor.

Since you have zero income at the moment, I would interpret that to mean... that your total asset value should be 5 times the poverty guideline income for your household size. So, if the poverty guideline income is $20,000, you should have assets worth at least $100,000 to be counted as a sole sponsor. Otherwise, you will need a joint sponsor, unless your wife's income can be counted (read the I-864 instructions).

If you plan to count your wife's income, the I-864 instructions state that her income should continue from the same source even after she becomes a lawful permanent resident.

Ahh!! I also said it 5 time the PG income and you are also saying the 5 times. Is it the 5 times or the 3 times for permanent resident??? Instruction says 3 times for citizen. But now our visa type falls into same category as those of citizen i.e. IR1/CR1.Right??

We are both still in the F2A category. However, since our priority dates will be current in the next month's bulletin, we will no longer have to wait for visa numbers to become available. In that sense, it will be "like" a US citizen sponsoring his spouse (IR-1) but not the same.

F2A can be upgraded to an IR-1 only if the sponsor becomes a US citizen during the processing period.

So, it will be 5 times for a permanent resident as you mentioned.

No case number yet. I have been asked to wait 10-20 business days from the date it reached NVC (March 25th). I'll let you know when I get it.

So that means when we get a visa within 4/5 months, our visa will still be of F2A category?? If yes, then how much it will be different from IR1/CR1 visa in terms of benifts like employment , education? Will F2A get the same privilege as IR1?

No difference at all. The visa is a green card. F2A and IR1 are just two different ways (among many) to get a green card.

At the end of the day, it is still a green card and the privileges are all the same.

4/5 months?? I will be current with the upcoming bulletin and you will be current either with the May or June bulletin. I am thinking 2 months tops! LET'S DO THIS!
