paper work adj of status?????

Here is where we are at. We have gotten married on november 3. the fiancee visa has expired on nov 11. still waiting to pick up marrige certificate. hoping it will be ready this friday. i am behind on filling out paperwork so i have a few questions. What name do i use for her on the paperwork? we have a social security number for her but we haven't changed her name yet because we don't have the marrige certificate yet. Is the social security office going to give us a difficult time changing her name because of the visa expiring? How long do i have to get the paper work in or am i already in trouble? Maybe these are silly question but i appreciate anyone who can help me out.

On the Adjust status paper work you will put her married name, and on the line marked other names used you will put maiden name.

As for name change on the SS card, don't bother until you either have EAD or Green Card in her married name. The SSA officer wont do the change until you provide them with those documents.

You have to at least wait until you have your marriage certificate so that you can send a copy. So after that you should do ASAP. Edited November 16, 2006 by YuAndDan

We did a little differently but its up to you if you want to or not - we applied for change of name on the SSN card with our marriage certificate (we had just applied for AOS then) - she took the application but didn't sound positive. It took about 8 or 10 weeks to get the SSN card with the married name though it had the 'not valid for work .. etc.' wording on it. We may go get this removed someday but don't feel we need to so far. Good Luck

I went to SS office to request a change of name, and they didn't do it. I was told to wait till my EAD arrives and then have it changed, and the reason was that I-94 was expired.
