So today is the 91st day since the NOA1 for my AP, EAD, and AOS.

AOS has had no touches or anything since they acknowledged receipt of the RFE materials a month ago.

EAD has never had any touches at all.

AP doesn't even show up in the system, and they say they can't find it in their computer, despite the fact that I have a NOA1 for it in my hand. Glad I spent that $170 there. They are "looking into it." They told me the same thing a month ago.

I spent 75 minutes on hold with USCIS today to get to talk to someone and ask what to do now that the EAD hasn't been issued within 90 days. Their web site says:

If you filed a Form I-765, Application for Employment Authorization, and it has been longer than 90 days since you filed and you haven't gotten an update from us within the last 60 days, and have not seen any public notice that addresses your case type, please don't wait the extra 30 days. Call customer service immediately.

Previously this meant you could get a temporary EAD until they got their act in gear and got you your real EAD or green card or whatever. No more.

Now what do they do? They take your name, address and phone number (they don't have it already from any of the 70 or so forms I've filed?!?!) and say they'll forward it to the processing center for them to "look into it." If I haven't heard back from them in 90 days, I'm to call them back.

Gee, great, thanks.

As for the AOS? Who knows???? It seems to be lost in the depths of a desk belonging to some vacationing USCIS agent. Virtually all of the CSC transferees who were transferred before me and almost a month after I was have already got their green cards. I haven't been touched in a month. The misinformation line said to call back in 90 days if I haven't heard anything.

I'm REALLY tired of this. :angry:

I can truly understand how you are feeling. It's been a month since anybody breathed on our paperwork, though we have since been told that we are awaiting the FBI name check (how long that takes is anybody's guess).

Have you started contacting your congressperson and your senate person? We started digging around for officials to help us, hence the reason we know its the FBI name check that they're waiting for. How long that takes is anybody's guess but at least we are reassured by the fact we have political types and so on on our case.

Isn't making it go any faster, mind, but at least we know we're not being ignored ^_^

I can't suggest any more personally, other than keeping us updated so that we can keep on encouraging you.

Did the RFE notice say anything about your EAD? Depending on the type of evidence requested, if the RFE referenced your EAD, the 90 day clock was either tolled or re-started altogether. In that case, you cannot simply count 90 days from your NOA1 date to determine your entitlement to a statutory 240 day EAD.

Let me try to explain the way the process works. First, to give you some background, under 8 CFR 274a.13(d) USCIS has 90 days from the date of their receipt of the application to issue you an employment authorization (there are a few categories of immigrants to whom the 90 day rule does not apply). USCIS' failure to comply with the 90 day requirement results in the automatic grant of an employment authorization for a period not to exceed 240 days.

Now, in the event that your employment authorization application is missing required INITIAL evidence, under 8 CFR 102.2 ( B )(10) the 90-day countdown does not start until USCIS receives that evidence.

Now, if your application is missing anything OTHER than the required initial evidence or if USCIS requests ADDITIONAL evidence, then the countdown clock is simply suspended until USCIS receives such evidence.

To illustrate, if your employment authorization petition has been with USCIS for 20 days, then USCIS requests additional evidence of your eligibility, USCIS will have 70 days to finish processing the application after USCIS receives the evidence. Now, under the same scenario, if the required INITIAL evidence was missing, USCIS would have the full 90 days after you submit such initial evidence to finish processing your application.

Hey,

don't be mad or sad, I think I have an explanation for what is happening with your files.

Since I talked to an USCIS officer just the other day because of the same issue(EAD application hasn't been approved within 90 days), she gave me the following reason which makes sense:

She said once an RFE is issued most EAD will be put on 'hold'...Once the RFE is received they will continue working on it- same with AOS.

Let's see your NOA 1 was dated for 8/16/2006

your RFE was dated for 10/04/2006, so your files have been in the system (at that point ) for 7 weeks, roughly 50 days...

They received your RFE on 10/20/2006, so they basically got another 40 days to work on your EAD....and for the AOS the 'normal' processing time is between 120-180 days, so they got 70-130days left to give you a decision.

The USCIS officer did some math on the phone...and she told me the exact same thing what I told you know...

SO, I believe, if you do not hear from them within (roughly) 40 days, you can go ahead and inquire whatever you need, but I believe up to this point everything is normal.

I can't speak for CSC transfers though- but I believe, you will hear something very soon- just remember, that even in the RFE notice it says that you will not be eligible for a work permit for 90 days AFTER they have recived the RFE.

I just recently mailed my RFE to them and have to wait as well...

Sorry to hear that you're still waiting for everything (and how "nice" to know that they "misplaced" your AP application and "will look into it" :angry: )

I can't speak for CSC transfers though-

According to my information which I received by calling the (mis-)information hotline (twice), the projected processing time for AOS cases that were transfered to CSC is "180 days from the date of the transfer".

Of course, you are completely right when you say that most CSC transfers are approved within a MUCH shorter timeframe.....but USCIS still has the right to take 180 days after the transfer to work on your case. And since your transfer happened not that long ago, they are unfortunately still "well within their projected timeframe" :(

Believe me, I do understand your feelings (my transfer happened on May 23 (!), so I only have a few more days to go until the 180-day-deadline.....looking forward to finding out which excuse they are going to use after that :blink: ). But in cases where they do give you a timeline and the case is still within that timeline, complaining to USCIS, congressmen, etc. usually doesn't help too much :(

Nope. The RFE was for seven items (six of which were sent in the original I-485/864):

- Tax transcript for 2005 tax year for USC

- Copy of W2 from 2005 for USC

- Employment letter from current employer for USC

- Bank letter for USC

- Bank statements for USC

- Proof of citizenship of USC sponsor

The seventh item was a divorce certificate for my USC wife, despite the fact that she has never been married (which was quite clear if they had actually bothered to read the application). All of the items had to do with materials about her, not about the EAD.

It was quite clear that the RFE was for the AOS and AOS only. The receipt number referenced was for the AOS, and no mention of any of the materials for the EAD was made.

Very nice that 8 CFR 274a.13 states what they must do, but as I have been told three times now by the misinformation line, they have decided that as of September 1st of this year, they "no longer do that." They simply send off a notice to the processing office to open an investigation as to why it is taking longer than 90 days.

Previous to September 1st, you would book an Infopass online, and select this option:

It has been more than 90 days since you filed an I-765 and you did not receive an Employment Authorization Card.

However, attempting to book an Infopass with that option selected now just gives you this result:

At this time, there are no information appointments available for the office in your area. Please try back again later.

It's quite clear that the USCIS regards the Code of Federal Regulations with the same disdain as they do their "customers."

I suppose I could sue the USCIS. If I had the money to do it just to pester them, I damn well would.

Actually, my RFE makes no mention of a work permit at all.

When I talked to the officer on the phone today, the first thing he said when pulling up the EAD file was, "oh, wow, this is way beyond 75 days, it should have gone through by now." I don't know where he got 75 days from, perhaps that is their internal standard?

Here is what CFR 8 274a.13(d) says, I have deleted some irrelevant portions that refer to Cuban and Haitian refugees:

Interim employment authorization. The district director shall adjudicate the application within 90 days from the date of receipt of the application by the INS. Failure to complete the adjudication within 90 days will result in the grant of an employment authorization document for a period not to exceed 240 days. Such authorization shall be subject to any conditions noted on the employment authorization document. However, if the director adjudicates the application prior to the expiration date of the interim employment authorization and denies the individual's employment authorization application, the interim employment authorization granted under this section shall automatically terminate as of the date of the director's adjudication and denial.

I don't know, but to me, that says it's done within 90 days of filing, or else they give you a temporary EAD - regardless of the status of any other application.

But then, those are only the federal regulations. We know how well the USCIS "interprets" and selectively ignores those already.

Sheesh Scott, this is ridiculous!!! If anyone has a right to complain about the USCIS it's you and Holly. Man, I'm so sorry for all this...I just hope they get it straightened out soon. Hopefully as soon as your EAD comes through they'll transfer your case to CSC. So did you make an Infopass appt?

You can't make an Infopass appointment for this - every attempt ends up with this result:

At this time, there are no information appointments available for the office in your area. Please try back again later.

I'm going to talk to them again tomorrow morning, and if I still get nowhere, I'm going to make an appointment and tell them it's for a different reason, so that at least it will give me one.

An RFE for the I485 slows down processing for all the interim benefits that are concurrently filed. All of your petitions 'stopped' with your RFE. So the 90 day time-frame in which they are supposed to issue the EAD gets thrown out the window with the RFE.

Even if your RFE doesn't mention anything about your EAD, your EAD authorization is based on your AOS application, and since your AOS application had an RFE, the clock on the EAD 90 day time limit starts OVER the day they receive your returned RFE. (And it's the day they put it in the computer, not the day they actually received it!)

We were in the same boat as you, except we at least have an AOS appt tomorrow. We had an RFE for tax returns, which like you I sent the first time.

I just got the email, our EAD was approved today. AOS appt tomorrow, so that about makes since. We're at day 67 since our RFE was show processed back by MSC. I was told I had ZERO recourse to do anything about the EAD until Dec 8th, the 91st day after they show the RFE returned. Period, end of story if your AOS has an RFE.

Like you I couldn't see our AP online for months, on top of that our EAD didn't show online for over 3 months, actually it was day 106 before they ever showed up online. That's because on day 92 I sent a snail male letter to the 'status inquiry' address asking for an answer to our EAD and AP, I also mentioned I was going to write every 14 days until an answer was given or at least the internet was updated. I had called the misinformation line 3 times and was told they would fix our AP and EAD and get them online, never happened. Our AOS only showed up the day they sent us the RFE. 2 weeks after sending the snail mail both my AP and EAD showed online.

So on day 123 we have EAD approval via email.

Day 124 (tomorrow) we go for our AOS.

AP, still nothing...

The adventure continues tomorrow at 10am...

Hang in there, you will get your EAD, probably about 70 days after the date they say you returned the RFE

It says it somewhere else.... I'll find the verbage for you and post it, but you're reading one little part....

If your EAD is based on your AOS, which if your married it is, then your EAD can't be processed until they have all your paperwork for the AOS. You have no leg to stand on until day 91 after the RFE shows returned in the USCIS system.

Nowhere does it say that you shall be approved for your AOS within 90 days without an interview but you seem to be expecting that also.

An RFE for evidence stops all concurrently filed interim benefits. Period.

You are ineligible for interim employment authorization pursuant to Title 8, Code of Federal Regulations, Section 103.2( b )(10)(ii) until (90) days after the missing intitial evidence is received.

And this is for an RFE on your AOS, not EAD.

Just because one part of the law says they must do it within 90 days, doesn't mean another part of the law doesn't give them exceptions. Case in point: I can show you where it's illegal to kill someone under US law, but I can also show you were it's legal if you're under threat of serious harm or death. For every law there is an exception somewhere...
