with all due respect, you can send anything into the service center and it will reach your file.

example:

when i was waiting for a response to our send back review from the embassy, i thought why wait until they ask and i just sent it in 3 months after the got our papers back from the embassy.

when i got the NOIR, i know my papers reached them because they referred to them in the letter.

but in light, i have to agree that it wasn't the G325A or the RFE that got the papers denied. it had to be something else they found. if it was those 2 things, they would have given you a chance to send in what they would have needed.

hang in there and wait for the paper letter to come.

When I sent in my petition I made a mistake on my G325a and I immediately noticed after sending. I called USCIS, they told me to send a letter outlining my mistake and they received it, I never got an RFE.

But I have to concur with everyone else, it must have been denied for something else, and RFE would have been sent if it were just a missing G325a, and pictures are not required

I always wonder why some get denied and others get an RFE. Why some submit very very little (The requirements) get to embassy and denied. Others get denied at USCIS. I wish they had one way and kept to it. Sorry OP.

I agree, a very good friend of mine only sent in the forms, no supporting evidence whatsoever with the petition, just sent the forms, the petition was approved, and at the interview her husband was approved, the CO didn't ask ask for any supporting evidence even though he brought it with him. This was at the same embassy my husband went through. With our petition we sent just the forms and a few pictures, and we were never asked for any additional evidence at the interview either. Would be nice if they were consistent with everyone.

Sure they can, if they want to. There are clear instructions with each type of application. The burden is on us to file properly.

I just checked the USCIS website and realised our case was denied. I could feel it coming as we have left out some document. I am really as we have to go over the process after waiting for eight months.

Here's a thought. You follow up on what I write below, let us know about it, aye?

Perhaps your casefile was sent to a local office, and it's one of those local offices that issues NOIDs and NOT RFEs. If that's the case, you can learn of it soonish by telephoning USCIS and talking with an ISO.

Regardless of where it is or was, it's my understanding that an I-130 is not denied until a NOID is issued, the petitioner respond to it, and the adjudicator review what was submitted.

Can tell us more stuff?

I dont know whats happening. On march 29 when i checked it on denied just checked my status is on initial review and that the alien number was changedd. can someone help wat does this mean .

Sorry :wow: Cheer up, go through the appeal process and re submit along eith the missing documents. THey should send you a detail letter whey you were denied so you will know how to proceed with your appeals. Good Louck and have faith it will work out.

The US spouse must call the USCIS and talk to a tier 2 and get some answers ASAP! Was it denied? Was it transferred to a local office? Was there an RFE? Find out what is going on!

A couple of people who have had this have usually got approved in the following days .... or got an RFE ... I don't want to get your hopes up if I'm wrong but looks like you might but done with this stage soon :) .. Good Luck

You can't randomly send in documents without a RFE. It may NEVER get added to you file and may just sit in a box somewhere. It is best to wait for a RFE.

uhm... you are wrong.. I did it upon the recommendation of the immigration officer I talked to at the local office while my case was still sitting on the shelf waiting
