Hi everyone,

I am filling out I864 to sponsor my husband, and I had a few questions, which I hope someone here might be able to answer.

I live with my parents and siblings (not working/students) here in the US and my father will be the joint sponsor since i am not employed at the moment. He will be filling out I854a. Would that be the correct form for him to fill out?

Ok so for I864 question 21 here is what I have so far,

a. 01

b. 1

c. 00 (not counting spouse twice)

d. 00

e. 00 ------ now for this one I am not sure if my siblings will be counted, but since they are not MY dependent I am assuming it's 00

f. 00

g. 01 ??? ----- for this I am not sure whether to just count my father since he's the one who will be the joint sponsor or count the other 3 members of the house as well?

Also going back to question 1, I have marked off A "I am the petitioner. I filed or am filing for the immigration of my relative." Would this be correct or should I mark off "e", but I am not sure what they mean by first and second joint sponsor. Am I the first sponsor and my father the second?

For question 20, should I leave it as a blank or mark off "NO".

Hopefully my questions made sense. Thank you so much.

You posted your question at 5pm on Easter Sunday, and bumped 1.5 hours later, give it some time :)

I don't know what form I854a is, but your dad will need to fill out form I-864, because he is not financially dependant on you. YOur mom, if she has income or filed joint tax returns with your dad, can fill in I-864A.

You are not counting your siblings, just yourself and your spouse (assuming you have no kids). Your dad will count himself, his wife, any kids that are minors or he claimed on tax returns, and your husband.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thank you so much! I know, lol should have waited a bit more.

So if my father fills out I864, then what form should I be filling out? I was told to fill out I864, so I am a little confused.

If anyone else can answer my other questions, that will be very kind of them :).

So I think I forgot to mention that for the 2012 tax return my father claimed me as dependent since I was not working (pregnancy/miscarriage/sickness etc). In this case do I still submit a separate I864 and my most recent tax return will be under my father's name. For the 2011 and 2010 tax returns I filed as independent since I was working during those years.

Maybe I should rephrase my question since it might seem confusing.

So my father will file I864 and claim me as his dependent, since for the most recent tax return I was his dependent. In this case I will still have to fill out a separate I864?

Since my 2011 tax return needs to be amended, I have decided not to send it with my I864 and instead take the amended at my husband's interview. So this leaves me with the option of sending the most recent tax return with my I864, but the most recent is the one I was claimed as a dependent of my father (also the cosponsor). Obviously my father will send in his last 3 tax returns with the I864. I don't have any income or savings to show, so I don't know whether it matters how many tax returns I send it. Hopefully this makes some sense. :)

You always file the I-864. As the spouse, you are the primary sponsor and even with zero income must file the I-864.
