Hey guys,

So, my father in law introduced me into hunting. I know this is a tough subject for some of us so please keep the negative comments to yourself. Now that AOS is complete, what is or how is it working if you purchase firearms? Has anyone done so?

The only reason I ask is I use my father in law's when we go hunting and now I want to purchase one of my own. He's been.. complaining about cleaning it and ####### after I use it :P So i'm curious if we can purchase them as Permament resident or not. How does it look on you if you do?

You will have to meet the age and residence requirements of your state. In most states I think that will mean you will need a driver's license or some other form of acceptable picture ID. Just call a local gun store, they can tell you.

Also, keep in mind that if you don't qualify to purchase yourself, then getting around the law by having another person purchase for you could get that person in trouble with the law.

You posed an intereting one for me here, I too am interested in this, my fiance was trained in firearms in her home country, and is interested in sport shooting. So I did some digging.

Here is the scoop:

In general, non-immigrant aliens are forbidden to possess any firearms or ammunition. But there is a big exception for a legal alien who: ...is in possession of a hunting license or permit lawfully issued in the United States. [say they came here to go on a hunting trip in a state like Montana].

Green-card holders and immigrant aliens who do not yet have their green card are both okay under federal law, although many people (including gun dealers, law enforcement officers, etc.) are not aware of the distinction or the hunting license exception, and erroneously think that either you have a green card, or you can't have guns.

Also, non-citizen cannot purchase a firearm from a federally licensed firerams dealer unless they have been a resident of their state for 90 days. So, no, tourists on short visits cannot walk into guns stores to get "protection" during their trip.

So i take it even though i'm a conditional green card, i should still be able to buy one no problem?

I just hope it doesn't affect my removing my conditions :P

If you are worried about that, have your spouse buy it.

In Alabama concerning firearms..........

I can have a gun in my house, and it doesnt have to be registered.

If I have one in my car, I have to have it registered by the Sheriff Dept.

March 9th, 2010, Received GC that has been lost in the mail for 10 months. Still waiting for my son's that is lost as well.

Filed Waiver for my son's 10 year GC and it was approved. He finally received his GC after its been missing for 2 years.

Thanking God this is over for 10 years.

A conditional green card is a green card in virtually every sense. Note that the card itself doesn't have "conditional" written on it. The only difference is that it expires after two years unless you go through the removal of conditions process.

Filing for removal of conditions is only about proving that the marriage was bona fide and not for the purpose of evading immigration law. They don't reexamine anything else.

So you're as good as any long-time green card holder as far as owning firearms. And yes, it's a constitutional right, phrased in the second amendment as "the right of the people (not just citizens) to keep and bear arms, shall not be infringed".

Just be sure you obey the laws regarding registration, permits, and the like. And be careful.

You should not have any problems. I have a glock and it is registered, I actually bought it for John as a present but had to register it when buying it. So I won't let him use it now cos legally it is mine :P

We are in WV and the law here is clear that you have to be a US Citizen to purchase a firearm.

My husband is an avid hunter also. We have an armory in the basement, every possible gun you could imagine and all the equipment to make his own bullets, sights, cleaning equipment, etc. When I went to purchase him a particular rifle for his birthday, I was unable to do so because at that time I wasn't a citizen. A friend of my husband's owns a gun store in VA and they don't sell to anyone other than citizens either and they have to go through a background check prior to release of the weapon to them. In the end the guy put the rifle aside for me, issued me a receipt, and told me that my husband would have to come into the shop to finalise the purchase, in his name. It was fine - and he was thrilled with it.

Both in VA and WV there is the requirement also that you have to take a "Hunter's Safety Course" prior to them issuing you a license. Personally, I think that is very important. It is amazing how many idiots there are in the forests with guns, come hunting season. We live in the middle of a very busy hunting area and people come from all over the county to hunt here. It worries me to death when you see those that have no clue what they are doing and have no idea of hunting etiquette. I am always relieved to see my husband and son home safe.

My son, who is not a Green Card holder, because of the nightmare we have had with immigration (4 years now) is hunting with my husband. He took the Safety Course and has a license, but the firearm he uses is not his, but my husbands, and this is quite legal.

I guess the laws are different in different states - I still find that weird. But I would suggest that you contact your local law enforcement officer and ask what the requirements are for your state.

Our journey started in 2001 and it's still not over. It's been a rollercoaster ride all the way! Let me off - I wanna be sick!
